The Will with two Codicils of William Winstanley late of St. Alban’s Everton Liverpool in the County of Lancaster Gentleman who died 23 July 1876 at Everton was proved at Liverpool by William Winstanley of 43 Grange-Mount Birkenhead in the County of Chester Warehouse Keeper the Son and William Knox of Crescent-chambers Liverpool Accountant the Executors.


A transcription of William Winstanley’s will


This is the last Will and Testament of me William Winstanley of 34 St Albans Everton Liverpool in the County of Lancaster Gentleman I direct that all my just debts funeral and testamentary expenses shall be paid and discharged by my Executors hereinafter named out of my personal estate but my funeral expenses shall not exceed the sum of thirty pounds I bequeath to my Sons Richard Timmis Winstanley & James Albert Winstanley all my wearing apparel to be equally divided between them immediately after my death I give and bequeath all my furniture plate linen glass china and other household effects which shall be in and about my dwellinghouse at the time of my decease unto my said executors hereinafter named Upon trust that they shall within three months sell the same by public auction and shall pay one half of the monies to arise from such sale after deducting the expenses thereof to my dear wife Jane to and for her own absolute use and benefit and the other half of the said monies shall be held by my said executors and considered as part of my personal estate but in case of the decease of my wife in my lifetime then I direct that the whole of the said monies shall be held as part of my personal estate I give and bequeath the sum of five pounds to each of my six children William Winstanley Richard Timmis Winstanley James Albert Winstanley Elizabeth Wife of Grindle Ragg Adelaide wife of Samuel Hind and Ellen Jane wife of David Mawha who shall be living at my decease and the sum of One pound ten shillings to each of the children then living of such children to purchase mourning I give and bequeath unto the said William Winstanley Richard Timmis Winstanley and James Albert Winstanley their executors administrators and assigns all my personal estate whatsoever and wheresoever not hereinbefore disposed of other than my leasehold estate Upon trust that they or the survivors or survivor of them or the executors or administrators of such survivor their or his assigns shall immediately after my death sell call in and convert into money such parts of the same as shall not consist of money and add the moneys to arise from such calling in sale and conversion and the ready money of which I shall be possessed at my decease to the half part of the product of the sale of my said furniture and other effects herein before mentioned and shall invest the same monies after payment of my funeral and testamentary expenses debts and legacies in the names or name or under the legal control of them or him my said Trustees or Trustee for the time being in any of the public stocks or funds or government securities of the United Kingdom or India or upon freehold leasehold or chattel real securities in the United Kingdom or in or upon the stocks funds shares debentures mortgages or securities or any Corporation Company municipal or public body and may from time to time vary or transpose such stocks funds shares or securities into or for others of any nature hereby authorised at their or his discretion I give devise and bequeath all my real and leasehold estate of what nature or kind soever and whether in possession Reversion remainder or expectancy (except estates vested in me upon trust or by way of mortgage) unto the said William Winstanley Richard Timmis Winstanley and James Albert Winstanley their heirs executors administrators and assigns respectively according to the nature and tenure thereof respectively Upon trust that the said William Winstanley Richard Timmis Winstanley and James Albert Winstanley or the survivors or survivor of them or the heirs executors or administrators respectively of such survivor their or his assigns or other the trustees or trustee for the time being of this my Will shall twenty one years after the decease or marriage again of my said wife which shall first happen or twenty one years after my decease if she shall happen to die in my life time sell my real and leasehold estates either together or in parcels and either by public auction or private treaty in contract with power to make any special or other stipulations as to title or evidence or commencement of title or otherwise which they or he shall think fit and to buy in or rescind or vary any contract for sale and resell without being responsible for any loss occasioned thereby and for the purposes aforesaid or any of them to execute and do all such assurances and things as they or he shall think fit and I declare that my said Trustees or trustee for the time being shall from the time of my decease stand & be possessed of all and singular my real leasehold and personal estate and the rents interest dividends and annual proceeds thereof and the securities on which the same shall be invested Upon trust out of the rents interest dividends and annual produce of the same to pay my said dear wife an annuity of forty pounds for the term of her natural life so long as she shall continue my widow and unmarried to be paid by weekly instalments in each year upon the death of my said wife the trustees or trustee shall pay the sum of fifteen pounds for her funeral expenses and upon further trust ten years after the death or marriage again of my said Wife ten years from the time of my decease in case I shall survive my said wife my said Trustees or Trustee to pay and divide the whole of the principal trust monies constituting my said personal estate except the monies arising from the sale of my leasehold estate and the interest dividends and annual proceeds which shall have arisen or be accumulated therefrom and the rents and profits of my real and leasehold estates unto and equally amongst such of my said children William Richard Timmis James Albert Elizabeth Adelaide and Ellen Jane as shall be living at the period of such division and the issue then living of such of them as shall be then dead having issue such issue taking only the share which his her or their respective parent would have been entitled to if living at the end of such period of the years share and share alike as tenants in common and not as joint tenants upon further trust until the period of division of the proceeds of the sale of my real and leasehold estates hereinafter mentioned shall each and every year pay and divide the rents and profits of such real and leasehold estate among such of my said children as shall be living at the end of each such year and the issue then living of such of them as shall be then dead leaving issue in manner and form aforesaid And upon further trust that my said trustees or trustee for the time being shall twenty one years from the time of my decease or the death or marriage again of my said wife when they or he have become possessed of the principal monies to arise from the sale of my said real and leasehold estate hereinbefore directed to be sold as aforesaid pay and equally divide the said last mentioned principal trust monies unto and equally between such of my said children as shall be then living and such of the issue as shall be then living and shall attain the age of twenty one years of such of them as may be then dead as tenants in common such issue taking the share only which his her or their own deceased parent would have taken if living at the end of such period of twenty one years provided always and I declare that my said trustees or trustee for the time being shall not at anytime hereafter borrow at interest or mortgage or otherwise incumber my said rent and leasehold estate but shall hold the same in trust for sale as aforesaid at the end of twenty one years after my death or the death or marriage again of my said wife as hereinbefore mentioned provided always and I declare that if any of my children who may take a vested interest under any of the trusts or powers of this my Will shall be outlawed or declared bankrupt or shall assign charge or incumber or attempt or affect to assign charge or incumber his share or proportion of my said real leasehold or personal estate or any part thereof or the accumulations thereof or shall do or suffer anything whereby the same or any part thereof would through his act or default or by operation or process of law or otherwise if belonging absolutely to him become vested in or payable to some other person or persons then and thenceforth the share or proportion of my said real and personal estate to which but for this provision he would be entitled shall be held in trust for the issue of such child of mine living at the period of distribution or division respectively and if there shall be no such issue then in trust for such of the others of my children as shall be then living and for such of the issue as shall be then living and shall attain twenty one of any of them who may be then dead leaving issue such issue taking only the share which his or her parents would have been entitled to if then living And I declare that my said trustees or trustee for the time being shall during such suspense of absolute vesting as aforesaid accumulate the said rents interest dividends and income in the way of compound interest by investing the same and the resulting income thereof in or upon any such stocks funds shares or securities as are hereinbefore mentioned for the benefit of the person of persons who under the trusts herein contained shall become entitled to the same And I hereby authorize my trustees or trustee to pay and apply the income of the share of any of the issue of my children during their minority for and towards his and her respective maintenance and education And I direct that any share or shares whether income or principal of my said estate which may become due to any of my daughters or any of the issue being female of any of my children shall be for her sole and separate use independently of any husband and of his debts control and engagements and her receipt alone shall be a discharge for the same and she shall not have power to dispose of or deprive herself of the benefit thereof by any manner of anticipation provided always and I hereby direct that if my said wife or any of my said children or their issue who shall become entitled to any share in my said estate shall at any time hereafter leave or recede from the Doctrine or Discipline of the Established Church of England and become members of the Church of Rome or any other Church or establishment or if any of my said children or their issue shall (becoming entitled as aforesaid) marry any persons not being a member of the established Church of England then all bequests benefits and provisoes made to or in favor of them her or him under this my will shall wholly cease and be inoperative And the share in my said estate to which such child or issue would have become entitled shall be disposed as if such child or issue had been dead before the period or periods of distribution as aforesaid And I further direct each of my children or such issue as aforesaid shall apply to and obtain from an ordained Minister of the Church of England an authenticated certificate of his or her conduct and conformity to the Church of England and obtain a certificate of their consistent conduct as members of the said Church of England and produce the same certificate to the trustees or trustee for the time being before receiving any share or portion of the principal of my estate it being my desire that all my children continue to remain members of the Established Church of England And I declare that upon every or any appointment of a new trustee or new trustees of this my Will the number of Trustees may be augmented or reduced and (in addition to the ordinary powers indemnity and right to reimbursement by law given to trustees) the trustees or trustee for the time being of this my Will shall be at liberty to dispense wholly or partially with the investigation or production of the lessors title on lending money on leasehold securities or otherwise to lease on any security with less than a marketable title and shall not be answerable for any less thereby occasioned I devise and bequeath all estates vested in me upon trust or by way of mortgage unto the said William Winstanley Richard Timmis Winstanley and James Albert Winstanley their heirs executors administrators and assigns respectively subject to the equities affecting the same respectively but the money secured on any such mortgage shall be treated as part of my personal estate And I appoint the said William Winstanley Richard Timmis Winstanley and James Albert Winstanley executors of this my Will and direct my said son William Winstanley to deduct and return to his own use the sum of fifteen pounds for every one hundred pounds of rents interest and dividends collected by him for his trouble in collecting the same and in connection with my estate. In witness whereof I have to this my last Will and Testament contained on this and the four preceding sheets of paper set my hand this third day of July One thousand eight hundred and seventy one

This is a Codicil to the last Will and Testament of me William Winstanley of 34 St Albans Everton Liverpool in the county of Lancaster Gentleman which will bears the date the third day of July One thousand eight hundred and seventy one Whereas I am desirous of revoking the appointment of my Sons Richard Timmis Winstanley and James Albert Winstanley named in my said Will as two of the trustees and executors thereof and of appointing William Knox of Crescent Chambers Lord Street Liverpool aforesaid Accountant as an additional trustee and Executor and I appoint the said William Knox a trustee and Executor of my said Will and I direct that my said Will shall be read and construed as if the name of the said William Knox had been inserted therein in the place and instead of the names of my said Sons Richard Timmis Winstanley and James Albert Winstanley as trustees and executors jointly with my Son William Winstanley the other trustee and executor therein named And I direct that in case my son William Winstanley shall cease to collect the rents interest and dividends of my estate and the said William Knox shall be selected to collect such rents interest and dividends he shall be allowed to deduct five pounds per cent out of the amount of money so received for his own use and benefit for his trouble in collecting the same and in connection with my estate I revoke the bequest in my said Will contained to my wife of one half of the proceeds of my furniture plate linen glass china and other household effects And I direct that the sum of fifteen shillings a week shall from the period of Three calendar months after my decease be paid to my said wife during her life or Widowhood out of the amount realized from the sale of the whole of my household furniture plate linen glass china and other household effects as directed by my said Will until the proceeds of such furniture and effects be exhausted but if any portion of such proceeds shall remain after the decease or marriage again of my wife I direct that the same shall form part of my residuary personal estate And in all other respects I confirm my said Will In witness whereof I have hereunto set my hand this first day of December One thousand eight hundred and seventy four

Commentary


The baptism seems very likely to be William’s, given that:


(1) The place and date agree with information given in censuses.

(2) Samuel was a mariner, as was William when he was young.

(3) William then would have followed the most conventional naming pattern, giving his eldest son his father’s name and his second daughter his mother’s name.
