James is known to have had a brother named Peter, and these were the parents of a Peter baptized in Wombourne in 1683 and another unnamed son baptized in 1688.


Spouse: Mary Hartell. Married 1 July 1711 in Wolverhampton, Staffordshire.

James's son Benjamin calls Ann his half-sister in his will, implying that she had a different mother. Mary is named in baptism records of her children. Mary was buried 14 February 1735 in Womborne, but said to be “of Swinford”, which is where the family had presumably recently moved. 


Spouse: Elizabeth Darby. Married 15 May 1742 in Ombersley, Worcestershire.

James names his wife Elizabeth in his will.


Brother: Edward Baynton (buried 26 July 1744 in Claines, Worcestershire).

Brother: Peter Baynton.

These relationships are given in a probate lawsuit over the will of Edward. Edward is described as an esquire, a widower, late of the tything of Whitstones in Claines, Worcestershire, but "late of the City of London and now at Newport, Isle of Wight and collector of HM Duty and Excise in the Isle of Wight." The occupation ties in with the occupation of James's son Benjamin.

Benjamin was an officer of excise in Winchester.

James’s will:


This is the last Will and Testament of me James Baynton of the Parish of Astley in the County of Worcester Yeoman First it is my will that my wife Elizabeth Baynton shall have and receive one annuity of Five Pounds clear of all Deductions to be Issuing and paid to her half yearly during her widowhood of my messuage Farm Lands and Tenements at Purcil Green in the County of Worcester which I Purchased and bought of George Parman Also I Give to Each of my Daughters the yearly Sum of Five Pounds to be Paid to them respectively half yearly during their respective lives also Clear of all Deductions and to be likewise Issuing and Payable out of my said Farm and Estate at Purcill Green Also my Will and desire is that within the space of Six Months next and imediately after the death of each of my Daughters namely Elizabeth and Ann Baynton the Sum of one Hundred Pounds shall be raised out of my said Estate at Purcel Green and Payable at that time to any child lawfully begotten on the Body of each Daughter so dying (but if more than one to be equally divided) And in case either of them shall happen to dye unmarried or without Children then my will and desire is that she and they (notwithstanding any Coverture or Marriage which may hereafter ensue) leaving no Child or Children (shall have and absolute Power by Will or otherwise) to Give and dispose of the sume of one Hundred Pounds a piece (to be raised as aforesaid) to and among her or their Nephews or Nieces as she or they shall think Proper and not elsewhere, and for that end and Purpose I hereby Charge and make Chargeable my said Estate at Purcill Green with the Payment of the Sum of Two Hundred Pounds of lawful money of Great Britain Also I Give and bequeath to the Children of my Daughter Mary Partridge the Sum of one Hundred Pounds to be raised as aforesaid, out of my said Estate at Purcill Green, after the Death of my said Daughter Mary and to be Paid within three months nex and imediately after her decease Also I Give my Son Benjamin the Sum of One Hundred Fifty Pounds to be paid him out of my Personal Estate and Effects Also I Give and Devise unto my son John Baynton and to his heirs All my said messuage Farm Lands Tenements and Premises at Purcill Green aforesaid Subject nevertheless to the Payment of the annuitys and Legacys above mentioned Except the one Hundred & Fifty Pounds to my son Benjamin which it is my will shall be raised & Paid out of my Personal Estate only Also I Give and bequeath all my Household Goodes & Furniture to my two Daughters Elizabeth & Ann to be equally divided between them Ann I do hereby appoint my Son John Sole Executor of this my will I hereby revoak all former wills by me made and declare this to be my last Will & Testament this Eighteenth day of June in the year of our Lord One Thousand Seven Hundred and Fifty Seven

First the Red Bed and best quilt four blankets foure pear of Sheets atable cloth sixe napkins achest of drawers with bas nobs anothers chest in the Same Room the large ovel table and dreser of drawers and nine puter dishes that stand upon it six chirds the large grate or a ginnue to by one wether shee will afier shawl and tongs with bras nobs three bras candle sticks aplate apot and kettle there bee too barels at John’s at Shenstone Shee might have them If shee will: mol as had some goods all Redday but give hir three pear of Sheets and adozin of plats likewise give To my Son Beniamin his unkels Chest of drawers and If he hath no Child of his own to give it When he hath done with it let him give it To Some of his nephews or neices and to noboddey Elce In my will I left my Son Beniamin a hundred and Fiftey pounds to bee paid out of my mortgage but when the mortgue is paid in: he Shall have a hundred and seventy pounds paid him and six pounds ayear in trust paid him as long as the monny lys: and let my wife and three daughters and John devide the rest of the intrust amonkest them and when the monney is paid in and Ben hath his Share paid him the Remander shall bee devided amounkest the above mentioned James Baynton


The will of James's son Benjamin:


I Benjamin Bainton of the parish of Bartholmew Hide in the City Winchester Hants Office of Excise do make and declare this my last Will and Testament written with my own hand after my Debts and Funeral Expences are paid I do dispose of my personal Estate and Effects as follows First I give and devise to my Nephew Joseph Bainton a son of my late Brother Stephen Bainton) all my wearing apparel both Linen and Woollen also I give devise and bequeath unto my Niece Ann Partride my Leasehold house and Garden (Situate in Hide Street in the City of Winchester and parish aforesaid) together with all my Household Goods and Furniture also I give to my half Sister Ann Hammond the Sum of Five Pounds of lawful Money of Great Britain and all the rest and residue of my Ready Money Securities for Money Stocks and other my Effects whatsoever and wheresoever exclusive of what is above in this will given and devised, I give and Devise to my Nephew Thomas Partridge in Trust to be Divided in manner following (that is to say) to be divided into Seven equal parts one equeal part to my Brother John Bainton and his hers three other equal parts to the Surviving Children of my late Brother Stephen Bainton share alike to my Sister Mary Partridge Widow and her Heirs two other equeal parts and the one other equal part to my Neice Ann Partridge and her Heirs. In the Name of God Amen I Edward Baynton of the City of London in the County of Middlesex but now of Newport in the Isle of Wight in the County of Southampton Collector of his Majestys Duty of Excise in the said Isle being ill but of sound and perfect Mind and Memory praised be God Do make and declare this my last Will and Testament in manner and Form following that is to say First and before all things I commit my Soul to Almighty God hoping for Salvation thrô Jesus Christ my Lord and Saviour and my Body I commit to the Earth to be decently Interred at the Discretion of my Executrix hereinafter named in Sure and certain hope of the Resurrection at the last day by the might power of God in Christ and as to such Worldly Goods wherewith it hath pleased almighty God to bless me I give devise and bequeath thereof in manner and Forme following First I give devise and bequeath unto my Beloved Wife Jane Baynton all my Estate Goods and Chattells Mortgages Bonds Notes moneys Rights and Creditts whatsoever for and towards her Maintenance and good Living during her Life so nevertheless and upon this Condition and it is my true Will and meaning that after the Death and Decease of my said Wife if any of my Estate Mortgages Bonds Notes Goods Chattles rights or Creditts or moneys shall remain and be unspent my said Wife towards her Necessary Maintenance for which I only give it to her and desire the same may not be changed or applyed or used other ways that then and in such case I give devise and bequeath all such of my said Estate Mortgages Bonds Bills Notes moneys rights and Creditts as shall be and remain unspent after the Death and Decease of my said Wife unto my affectionate Brother James Baynton his Extors and admtors and I do hereby nominate constitute and appoint my Loving Wife Jane Baynton whole and Sole Executrix of this my last Will and Testament revoking all former Wills by me made In Witness whereof I have to this my last Will and Testamt sett my hand and Seal this ninth day of February in the Sixth year of the Reign of our Sovereign Lord George the Second over Great Britain &c annoque dmi 1732. On the nineteenth day of October in the year of our Lord one thousand Seven hundred and Forty Four Power was granted to James Baynton the Natural and Lawfull Brother next of Kin and residuary Legatee named in the last Will and Testament of Edward Baynton late of the Tything of Whistones in the Parish of Claynes in the County of Worcester Widower deceased to administer the Goods Chattells and Creditts of the said deceased according to the Tenor of the said Will (for that Jane Baynton the Wife of the said deceased and sole Executrix in the said Will dyed in the Life time of the said Testator) he the said James Baynton being first Sworn by Commission duly to adminster Letters of adminstration of the Goods of the said Deceased (as dying Intestate) granted to the said James Baynton in August last being first voluntarily brought in and declared Null and void./
