In the name of god amen I John Wagstaffe of Knightcoate in the p[ar]ish of greate dassett in the Countie of Warwick yeoman being of p[er]fect memory and in good health doe make this my last will and testament First I give and bequeath my soule unto the hands of Almightie god my Creator and Jesus Christ my onlie saviour and Redeemer by whose death onlie and by no meanes of myne owne I hope to be saved, and my body to the earth from whence it came And touchinge the disposinge of my goodes and chattels I will that the deede of gifte which I have made to my son Giles, and the lease which I have made of the p[ar]te of my farme in knightscoate affore unto the said Giles and unto Richard Profitt shall stand and be of force to p[er]forme the trust which I reposed in them. Item I doe give to my sonne James the mault mill and to the said James his wife the Bruinge lead and to their eldest sonne william wagstaffe my best putt and pan and to each the rest of his children that shalbe livinge at the time of my decease a hoggrill a peece Item I give to each of my three yonger sonnes that is Thomas William and John Wagstaffe xxs apeece Item I give my sonne Richard Proffitt xls in money and to Johane Proffitt his wife the second brasse pott, to their eldest sonne my god sonne xls, to their second sonne Peeter Proffitt xxs, to Willia[m] Proffitt their third sonne xxs, to their eldest daughter Mary Proffitt a hundred markes to be paid at the daie of her marriadge or at their yeares of xxx which shall first happen excepte I give her an other porcon in my life time to Sara Proffitt xxs to Elizabeth Proffitt a hoggrill Item I give to John Lidbrooke my sonne in law xxs and to his wife my iijd pott, to his eldest sonne my godsonne xls to each of the rest of his children which shalbe living at the time of my decease a hoggrill apeece, to the Church of greate dassett xs to the bells there vs to the poore of the p[ar]ish of dassett aforesaid and for my funerall as it shall seem good to my Executor The residue of my goods and chattells debts and creditts not above by these presents bequeathed I give to my said sonne Gyles whome I make sole executor of this my last will and testament And I intreate my good frends and sonne in lawes Richard Proffitt and John Lidbrooke to be my Overseers of this my will and to see the same and the trust of my said deed of gift and lease to be p[er]formed In witnes whereof I have hereto putt my hand and seale the first day of March in the fifth yeare of the raigne of our sov[er]aigne lord kinge James annoque dni 1607

The will of John’s son William Wagstaff:

In the name of god Amen, The twelveth day of Aprill Anno Domini one thousand six hundred thirty eight and in the fowerteenth yeare of the raigne of our soveraigne Lord Kinge Charles of England Scotland France and Ireland Defender of the faith &c. I William Wagstaffe of Farmbrough in the County of Warr gent Cittizen and dyer of London beinge in good and p[er]fecte mynde and memory for which I give most humble and harty thankes to Allmighty god doe ordaine and declare this my last will and testamt in manner and forme followinge revokinge all former wills by me att any time heretofore made, Frist and before all things I comend and comitt my soule to Allmighty god my Creator trustinge most assuredly to be saved by the death passion and only merritts of Jesus Christ my Saviour and redeemer  And I will that my bodie bee decently interred in Christian buriall in the p[ar]ishe Church of Farmbrough aforesaid as myne executor hereafter named shall order and appointe  Item I forgive p[ar]don and release all my debtes whatsoever of all the debts due or owinge to me  Item I give to Mr William Gorstlowe the Minister of Farmbrough aforesaid tenn poundes in mony, Item I give to all the poore people in the towne of Farmbrough Fortie shillings apeece in money to be paied by my executor hereafter named presentlie after my decease, Item I give to Michaell Corbett of Farmbrough aforesaid over and above the fortie shillings formerly nowe dwelleth to be built by my executor hereafter named as speedily as he can for the said Richard Dury, Item I give to the said Richard Drury one hundred poundes in money Item I give to the said Michaell Corbett tenn poundes more in money over and above the legacies formerly given unto him  Item I give to Isabell Furner my maide servant twenty poundes in money to be paied to her by my executor presently after my decease, Item I give to my cosen Thomas Wagstaffe the sonne of Thomas Wagstaffe deceased my late brother one hundred poundes in money to putt him apprentice and to make him astocke when his time is out, And if he dy before his apprentishipp bee ended the residue of his legacie to be devided amongst his brothers and sisters or soe many of them as shalbe then livinge p[ar]te and p[ar]te like, Item I give to William Waggstaffe my kinsman brother of my said kinsman Thomas tenn poundes in money  Item I give to all the rest of my brother Thomas Wagstafe his children twentie poundes a peece in money, Item I give to my said brothers wife twenty poundes in money, Item I give to my goddaughter Mary Atwood twenty poundes in money.  Item I give to all the rest of my brother James Wagstaffe his children (excepte his sonne John twenty poundes a peece,  Item I give to the said John Wagstaffe my said brother James his sonne and to his heires and assignes forever my twoe howses in london with theire and everie of theire rights members and appurtenances, Item I give to my kinsman James Wagstaffe the sonne of William Wagstaffe deceased and to his heires and assignes forever All that my yardland of arrable meadowe and pasture and close with thappurtenancs in Knightcote in the said County of Warr. nowe in the occupacon of John Tailor or his assignes, And my desire is that the said John Tailor shalbe tennt to the same att the same rent he nowe paieth, untill my said kinsman James Wagstaffe be fower and twenty yeares of age, Item I give and bequeath to my kinsman William Wagstaffe brother of the said James and sonne of the said William Wagstaffe my kinsman deceased and to his heires of his bodie lawfully begotten, All that my Mansion howse wherein I nowe dwell in Farmbrough a foresaid and all other my lands tenements and hereditaments whatsoever in Farmbrough aforesaid with theire and every of theire rights members and appurtenances whatsoever, And for default of such issue of the bodie of my said William Wagstaffe, I give and bequeath my said Mansion howse lands tenements and hereditaments in Farmbrough aforesaid with the rights members and appurtenancs unto William Wagstaffe my kinsman sonne of John Wagstaffe my kinsman and to the heires of the bodies of the said William Wagstaffe sonne of the said John lawfully begotten, And for default of such issue, I give and bequeath All my said Mansion howse lands tenemts of me the said William Wagstaffe forever, Item I give and bequeth to my brother James Wagstaffe of Knightcot tenn poundes in money, Item I give and bequeath to my said kinsman John Wagstaffe sonne of my said brother James All my howseholdstuffe and bookes in my howse in Farmbrough aforesaid wherein I nowe dwell.  Item I give to every one of the said Richard Drurys Children tenn shillings a peece in money, Item I give to every one of the said Michaell Corbetts Children five shillings apeece in money, Item I give to my brother Giles Wagstaffe my executor hereafter named my best Cloake, Item I give to my said brother Giles his three daughters tenn poundes apeece in money, Item I give to Thomas Wagstaffe my said brother Giles his sonne three hundred poundes in money, And my will is that all the legacies herein before given and noe time appointed for payment thereof my will is shalbe paied by my executor hereafter named within one yeare nexte after my decease, Item I give to the poore of Upper Boddington five poundes in money, Item I give to the poore people of Knightcot and Northend in the p[ar]ishe of Burton Dassett tenn poundes in money, Item I give to my brother in lawe John Lidbrooke and to my sister his wife Forty shillinges in money  Item I give to James Lidbrooke sonne of the said John five poundes in money. Item I give to Henry Makepeace and Mary his wife of Napton on the hill five poundes, Item my will and meaninge is that my said kinsman William Wagstaffe sonne of the said William Wagstaffe deceased shall not enter upon or have or enioy the said Mansion howse lands tenements and hereditamts herein before given unto him untill he shall attaine unto the age of twentie and fower yeares any thinge in this my will contained to the contrary thereof in any wise not withstandinge, And my will desire and meaninge is that if the said William Wagstaffe my kinsman sonne of the said William Wagstaffe deceased shall dep[ar]te this life before he shall attaine unto the said age of fower and twenty yeares That then the said William Wagstaffe sonne of the said John nor the issue of the said William sonne of the said William shall not enter upon have hould or enioy the said Mansion howse lands tenemts and hereditaments herein before given unto them nor take and proffitt thereof untill the said issue of the said William Wagstaffe sonne of the said William or the said William Wagstaffe sonne of the said John shall attaine the age of one and twenty yeares any thinge in this my will contained to the contrary thereof in ane wise Notwithstandinge, Item I give and bequeath to my said brother Giles Wagstaffe All my said Mansion howse lands tenemts, and hereditaments with there appurtenancs in Farmbrough aforesaid, To have and to hould the same unto the said Giles Wagstaffe his executors administrators and assignes from and after my decease shall attaine to this said age, Then to have and to hould the same Mansion howse lands and premisses untill the issue of my said kinsman William sonne of the said William deceased bee one and twentie yeares of age And in case my said kinsman dye without issue, Then the said Giles Wagstaffe his executors adminstrators and assignes, To have hould and enioy the said Mansion howse lands and premisses untill my said kinsman William sonne of John be one and twentie yeares of age and in Case the said William sonne of the said John dye before his said age of one and twentie yeares then my will is that the said Giles his executors adminstrators and assignes shall have and enioy the said premisses till the issue of William sonne of the said John if he shall have anie or untill my right heires shall attaine to the age of one and twentie yeares, Item my desire is that George Hains hould the quarterne land I bought of his brother att a reasonable rent and bee well dealt with for the same, Item I give the Minister of Farmbrough aforesaid for the time beinge forever forty shillings per annum to preach fower Sermons yearly everie quarter one in the Church of Farmbrough aforesaid in remembrance of my beneficence which said fortie shillings per Annum I doe will and appointe shalbe paied out of my lands in Farmbrough aforesaid herein before given to my kindred, Item I give unto my said brother Giles Wagstaffe all the rest of my goodes Cattells Chattells and readie money whatsoever my debts beinge paied and my legacies and funerall expences discharged, And I make and ordaine my said brother Giles Wagstaffe my sole executor of this my last will and testament Willinge and requiringe him to p[er]forme the same / In Witnes whereof I have to this my last will and testamt sett my hand and seale the day and yeare first above written, William Wagstaffe, Sealed published and subscribed in the presence of us John Swaine  George Haines his marke Ambrose Holbech.
