Evidence


The 1613 will of Peter Browne mentions his son Thomas Browne’s “kinsmen”, Mr Thomas Warton and John Warton. These must be the Thomas Warton and John Warton who appear one after another on a list of tythe payers for the parish of Stottesdon drawn up in about 1613. Their residence is “Bardley”. I think this is the same place as the modern Bardley Court, between Stottesdon and Neen Savage.

Memoranda that on or abouts the Sixth day of October in An[n]o d[omi]ni 1624 Thomas Wharton late while he lived of the p[ar]ishe of Stotesdon and dioces of Herford deceased being sicke in body but of good and p[er]fect mind and memory made and declared his last will and testament nuncupative in maner & forme following vizt First he gave and bequeathed unto Francis Wharton the bedsteed in the chamber wherein he then Lay one greene [...sh] one Blanckett two paire of sheetes one wainscott presse with two little cublards in the upp[er] p[ar]te thereof the longe table boord in the hall one Chaier and two cushens all his glasse and his best silverspoone, Item the said deceadents will was that the said Frauncis Wharton should have his diet with his Executrix hereafter named during the space of one yeare & a day next after his decease and that he should alsoe have the iainct[?] use of all implements of husbandry of his the deceadents during the said terme and space of one yeare and a day next after his decease And that at the end of the said terme the same should be equally devided betweene them The same implements of husbandry being kept & maintained during the said terme at their equall chardges, Item his will further was that the said Frauncis Wharton should at his owne prop[er] costs and chardges finishe make up and cover the Cowhouse and building that was to be then erected upon the tente[?] wherein the said deceadent then dwelled (The greate timber being first reared) And that he should alsoe suffer Elizabeth Wharton his the deceadents daughter quietly to enioie all such Legacies as are by him to her bequeathed by this his last will & testament Or else all such Legacies as are by the same will bequeathed unto the said Frauncis Wharton should be void And then his will was and he gave and bequeathed all the foresaid Legacies given and bequeathed unto the said Frauncis, unto the said Elizabeth, And unto the said Frauncis the sum[m]e of twelve pence of lawfull money of England Item he gave and bequeathed unto John Wharton his sonne one bed with furniture belonging to the same such a one as his executrix should thincke fitt all his wearing App[ar]ell and two cushions Item he gave and bequeathed unto Elizabeth Wharton daughter of Wm Wharton one Calfe to be kept by his executrix untill it be a yeare ould Item he gave and bequeathed unto Joice Hughes one Calfe of a yeare ould Item he gave and bequeathed unto Thomas Wharton and John Wharton sonnes of his sonne John Wharton either of them one yeare ould Calfe Item he gave and bequeathed unto Thomas Wharton sonne of William Wharton one silver spoone and to Martha Wharton daughter of the said Wm Wharton one silver spoone And of this his last will and testament he did constitute and appoint Elizabeth Wharton his daughter to be his sole Executrix in the p[re]sence of Thomas Quinersley gen two others

Commentary


I think this is the most likely scenario:


The Mr Thomas Warton and John Warton named in Peter Browne’s will as kinsmen of his son Thomas Browne were brothers of Peter’s wife Mary Warton. This Thomas Warton married in 1579 and left the 1624 will. The John Warton was probably baptized in 1567 and married in 1596 in Culmington.


It seems less likely that the Mary Warton of this page was baptized in 1581, and that the Wartons named in Peter Browne’s will as Thomas Browne’s “kinsmen” were Thomas’s grandfather and great-uncle.
