I Ann Almond of Wigan in the County of Lancaster Widow and Relict and also Executrix named in the last Will and Testament of Robert Almond late of Wigan aforesaid Bucklemaker deceased do make and publish this my last Will and Testament in Manner following (that is to say) Whereas my said late Husband did in and by his last Will and Testament in Writing duly published and executed bearing Date on or about the Nineteenth Day of March which was in the Year of our Lord One Thousand Seven Hundred and Fifty Seven amongst other Things and Bequests give and bequeath the Messuage or Burgage in the Millgate wherein the said Testator then dwelt unto his Son Roger Almond his Heirs and Assigns for ever And as for and concerning all the Rest Residue and Remainder of his Estate he gave devised and bequeathed the same unto me my Heirs Executors Administrators and Assigns for ever Upon Trust and Confidence that I or my Assigns should or might have receive and take the Rents Issues and Profits of his Real Estates and have and enjoy the Use Benefit and Advantage of his personal Estate during my natural Life And from and after my Decease Upon further Trust that my Heirs Executors and Adm’ors should sell and dispose of his my said late Husband’s Real and Personal Estates as soon as conveniently might be after my Decease for the best Price or Prices that could or might be had or gotten for the same And to pay divide and distribute the Moneys to be raised thereby unto and amongst his Son Roger Almond and his Grandchildren the Children of his Daughter Ann Gaulter Widow deceased in such Shares and Proportions and at such Time and Times and in such Manner and Form as I his said Wife should by my last Will and Testament in Writing direct or appoint As in and by the said Will of my said late Husband on Relation thereto had may more fully appear And whereas I have advanced and paid several Sums of money in Discharge of the Debts Funeral Expences and Probate of the said Will of my said late Husband and in the Preferment and Advancement of my said Son the said Roger Almond and in the Education Maintenance and Preferment of my Grandchildren the said Children of the said Ann Gaulter And for that Purpose I have not only applied and disposed of my said late Husband’s Personal Estate but have sold and disposed of one Messuage or Dwelling House in the Millgate Street in Wigan aforesaid being Part of the said Real Estate of my said late Husband unto James Smith of Wigan aforesaid Blacksmith for the best Price that could be had or gotten for the same And have also for the same Purpose borrowed and taken up at Interest from John Ainsworth of Wigan of Wigan aforesaid Chapman the Sum of One Hundred and One Pounds of lawful British Money for which I now stand indebted to him Now I the said Ann Almond in pursuance and by Virtue of the several Powers and Authorities given to and vest in me by the said Will of my said late Husband and of all other Powers and Authorities whatsoever do hereby order direct limit and appoint that my Heirs and my Executors hereinafter named do and shall with all convenient Speed after my Decease not only ratify and confirm the Sale of the said Messuage sold to the said James Smith as aforesaid but also sell and absolutely dispose of all and every the Messuages Lands Tenements Goods Chattles and Hereditaments whereof I shall be possessed at the Time of my Decease for the best Price or Prices and most Moneys that can or may be had or gotten for the same And by and with the Moneys to be raised thereby do and shall pay off and discharge to the said John Ainsworth his Executors Administrators or Assigns the said Sum of One Hundred and One Pounds all accrueing Interest to become due for the same And after Payment thereof do and shall pay and apply the Remainder of the said Moneys to be raised as aforesaid for and towards the Payment and Satisfaction of all such Debts and Sums of Money as I shall owe at my Decease and my funeral Expences and the Charges of the Probate of this my Will And from and after Payment thereof and of all Costs and Charges attending the selling and disposing of the said Premisses and raising receiving and paying the said Moneys I do give devise bequeath direct limit and appoint all the Remainder of the said Moneys to be raised as aforesaid in Manner following (that is to say) The Sum of Thirty Pounds Part thereof unto my Grandaughter Elizabeth the Wife of Benjamin Ashall and to be paid to her within Twelve Months next after my Decease and for her own Sole and separate Use exclusive of her said Husband and that her Receipt shall be a sufficient Discharge for the same unto my said Executors And the sum of One Shilling other Part thereof unto my Grandaughter Margery the Wife of Thomas Philips and no more And the Sum of One Shilling other Part thereof unto my Grandaughter Ann the Wife of John Tudor and no more And the Sum of One Shilling other Part thereof unto my Grandaughter Catherine Walsh and no more (They the said Elizabeth Ashall Marjery Philips Ann Tudor and Catherine Walsh being all the Children of the said Ann Gaulter) And from and after Payment thereof I do give devise bequeath direct limit and appoint all the Rest Residue and Remainder of the said Moneys to be raised as aforesaid unto my said Son Roger Almond his Executors Administrators and Assigns for ever And lastly I nominate constitute and appoint my said Son Roger Almond and William Johnston of Wigan aforesaid Merchant and James Heyes of Wigan aforesaid Ironmonger Executors of this my Will And I do direct that my said Executors shall and may deduct and retain to themselves out of the said Trust Moneys and Effects which shall come to their Hands all such Costs Charges and Expences as they or any of them shall bear pay sustain or be put unto in or about the management or Defence of the Trusts hereby created or reposed in them And they they or any of them shall not be answerable or accountable for anymore of the said Estates Moneys and Effects than what they shall actually receive nor for the Acts Deeds Receipts Neglects or Defaults of each other but each of them for his own Acts Deeds Receipts Neglects and Defaults only And I do declare this to be my last Will and Testament and do hereby revoke all former and other Wills by me at any Time heretofore made (In Witness whereof I have hereunto set my Hand and Seal the thirtieth Day of January in the Year of our Lord One Thousand Seven Hundred and Seventy Two
