A transcription of the Will of Nathaniel Arnold

In the Name of God Amen I Nathaniel Arnold of Southam in the County of Warw. Farrier being weak of Body but of sound & perfect Memory (praised be God) do make & ordain this my last Will & Testament in Manner & Form following (that is to say) First & principally I comend my Soul into the Hands of Almighty God, hoping through the Merit, Death & Passion of my Saviour Jesus Christ to have full & free pardon & forgiveness of all my Sins, & to inherit everlasting Life. And my body I commit to the Earth to be decently buried at the Discretion of my Extrix, hereinafter named. And as touching the Disposition of such worldly Estate as it hath pleased Almighty God to bestow upon me, I give & dispose thereof as followeth. Impimis. I will that all my debts and funeral Expences be paid & discharged. Item. I give & bequeath to my Son John Arnold of Southam aforesaid the sum of one Shilling. Item. I give to my Daughter Elizabeth Cooke Wife of John Cook of Long Itchington in the County aforesaid, Husbandman, the sum of one Shilling. Item. I bequeath to my ten Grand-Children, in whatsoever place living, one Shilling each. Item. All the Rest & Residue of my personal Estate, Money, Goods & Chattels with the dwelling House & Shop which I hold by Deed situate and being in Southam aforesaid together with all the Appurtenances thereunto belonging or in any Wise to me appertaining, I give unto Elizabeth Arnold my dear & loving Wife Whom I make my full & sole Extrix of this my last Will & Testamt Revoking by it all former Wills by me heretofore made. In Witness whereof I have hereunto set my Hand & Seal this tenth Day of November in the Year of our Lord Christ according to the count now used in England 1737.

But further I will that after my Decease & the Decease of my said Wife Eliz. Arnold the Dwelling House & Shop above mentioned with all the Appurtenances for the then ensuing Term of the Lease shall descend to my said Son John Arnold of Southam Farrier.

A transcription of the Will of John Arnold (proved 1761)

In the Name of God Amen I John Arnold the Elder of Southam in the County of Warwick Farrier being of sound and disposing mind and memory do make and ordain this to be my last will and Testament in manner following that is to say First and principally I commend my Soul into the hands of Almighty God my Creator hoping for mercy and pardon for all my Sins through the merits of my Redeemer Christ Jesus my body I commit to the Earth to be decently interred at the discretion of my Executors hereafter named and as to such temporal Estate as it hath pleased God to bestow upon me I do give bequeath and devise the same as follows that is to say I do give and devise unto my Friends Butler Wiggan of Kingston in the said County Gentleman and Thomas Goodman of Honingham in the said County Yeoman and to their Heirs and Assigns for every and To the use of them their heirs and Assigns for ever All that my Close of pasture or inclosed ground in Southam aforesaid called Brandons Close with the appurtenances In Trust nevertheless that they the said Butler Wiggan and Thomas Goodman and the Survivor of them and the Heirs and Assigns of such Survivor do and shall by and out of the Rents and profits of the same Close in the first place pay unto my wife Mary Arnold and her Assigns for and during the term of her natural life the sum of Fourteen pounds a Year clear of all payments and deductions whatsoever by two equal half yearly payments in the Year the first payment thereof to commence im[m]ediately on my decease and do and shall in the next place pay unto my Cousins Nathaniel Arnold and Mary the wife of Thomas Holloway & their Assigns (after deducting the Landtax of the whole of the said Close and their Costs and charges) the remainder of the rent of the said Close for and during their lives and the life of the longer liver of them by two equal half yearly payments in the year the first payment thereof to commence im[m]ediately in my decease and in case my said wife shall happen to dye during the lives of the said Nathaniel Arnold and Mary Holloway or the Survivor of them Then the said Trustees or the Survivor of them shall retain in their hands the said remainder of the rent of the same Close for the purposes hereafter mentioned and from and after the decease of my said wife & the said Nathaniel Arnold and Mary Holloway Then upon Trust that they the said Butler Wiggan and Thomas Goodman and the Survivor of them and the heirs and Assigns of such Survivor do and shall with all convenient speed sell and dispose of the same Close to such person or persons who shall be willing to become purchasors thereof for the most money and the best price and prices as can or may be had or gotten for the same and do and shall pay and apply the money arising by such sale as also what money they shall have in their hands by perception of the rents of the same Close in case my said wife shall dye during the lives of the said Nathaniel Arnold and Mary Holloway or the Survivor of them or in case the said Nathaniel Arnold and Mary Holloway or the Survivor of them shall dye during the life of my said wife in the manner and for the purposes hereafter mentioned that is to say (after deducting all such Costs Charges and expences as they shall sustain or be put unto in and about the same) unto my Nephews and Nieces Samuel Arnold one Eighth part thereof, John Arnold Jun.r one other Eighth part thereof, Richard Arnold on other Eighth part thereof, Thomas Arnold on other Eighth part thereof, Mary the wife of Abraham Hodgkins one other Eighth part thereof, Elizabeth the wife of Robert Eaglesfield one other Eighth part thereof, & to Robert Campton one other Eighth part thereof and to Thomas and Catherine Cook children of Thomas Cook of Long Itchington the remaining Eighth part thereof equally to be divided betwixt them share and share alike

Item I do give and bequeath unto Elizabeth Cook and the said Thomas Cooke the sum of one Guinea apiece of lawfull money and unto Elizabeth the Daughter of the said Nathaniel Arnold and Mary Dury my wifes Daughter I give the sum of Twenty pounds apiece of lawfull money and I do devise the same to be paid within twelve months next after my decease Item I do give and bequeath unto my said wife the sum of Five guineas of lawfull money and also my Silver Cup three tea spoons Tea kettle bed and bedding in the parlour & I do direct the same to be paid and delivered to her im[m]ediately on my decease

Item I do give and bequeath unto the poor of the parish of Southam aforesaid the sum of five pounds of lawfull money and unto John Overton of Long Itchington I do give my Chest of Drawers standing in the parlour my large Chest above stairs and three pewter Dishes And to the said Robert Campton I do give two Silver spoons marked (S.C.) and all other my household goods linen and furniture of household except my wearing apparel which I do give unto the said Nathaniel Arnold and Thomas Holloway equally to be divided between them.

Item I do give and bequeath unto Nathaniel the Son of the said John Arnold Jun.r my Horse or mare in case I shall have one at my decease and to Judith George I do give the sum of Six pence a week during her life to be paid to her by my Executors

Item I do give and devise unto Mary the wife of John Pratt of Southam aforesaid all that my Messuage or Tenement and Stable thereto adjoining being one Horse’s Stall and a piece of garden ground Four yards square in the tenure of John Jenson and to her heirs and Assigns forever

Item I do give and bequeath unto the said Butler Wiggan and Thomas Goodman to their own use Five guineas apiece as an acknowledgement for the care and trouble they may have in the Execution of this my Will

Item I do give devise and bequeath unto and to the use of the said Butler Wiggan and Thomas Goodman their heirs Executors and Admin[istrat]ors & Assigns for ever All that my Messuage or Tenement wherein I now live and all that my quartern land in Southam aforesaid And all those two Closes called the Oldfords in Southam aforesaid and also all my personal Estate of what nature or kindsoever not hereinbefore by me disposed of In Trust nevertheless that they the said Butler Wiggan and Thomas Goodman or the Survivor of them or the Heirs Executors or Adm[inistrat]ors of such Survivor do and shall with all convenient speed after my decease sell and dispose of the same Messuage or Tenement Closes lands and premisses and also my said personal Estate to the best purchasor or purchasors and for the best price and prices which can or may be had or gotten for the same and by and out of the money arising by such Sale or Sales do and shall in the first place (after deducting all such Costs and Charges and Expences as they shall sustain or be put unto) pay off and discharge all and every my just debts and all and every the Legacys above mentioned and do and shall pay and apply the residue of the money arising by such Sale in the manner and for the purposes hereafter mentioned that is to say one Eighth part thereof (the whole in Eight equal parts to be divided) unto the said Samuel Arnold one other Eighth part thereof unto the said John Arnold Jun.r one other Eighth part thereof unto the said Richard Arnold one other Eighth part thereof unto the said Thomas Arnold on other Eight part thereof unto the said Mary Hodgkins one other Eighth part thereof unto the said Elizabeth Eaglesfield one other Eighth part thereof the said Robert Campton and the remaining eighth part thereof unto the said Thomas and Catherine Cook equally to be divided between them share and share alike and I do hereby direct that all the moneys which the said Thomas and Catherine Cooke will be intitled unto under this my will be paid to them at their equal ages of twenty one years and in case either of them shall dye before his or her Legacy or Legacys shall become payable the whole to go to the Survivor of them and I do direct the same to be placed out at Interest for their maintenance and Education

Provided always and my will is that the said Butler Wiggan and Thomas Goodman shall not either of them or the Heirs Executors Admin[istrat]ors or Assigns of either of them be answerable or accountable for any money to be received by Virtue of the Trusts hereby in them reposed or for the acts receipts neglects or defaults the one of the other or for the deficiency of any Security or Securitys but that each of them shall be answerable or accountable only for such sum or sums of money as he shall respectively actually receive

Item I do nominate constitute and appoint the said Butler Wiggan & Thomas Goodman joint Executors of this my will hereby revoking all former wills by me at any time heretofore made and I do publish and declare this to be my last will and Testament In Witness whereof I the said Testator John Arnold have to the three first sheets of this my will contained in Four sheets of paper set my hand and to the last my hand and Seal this twenty seventh day of March in the Year of our Lord one thousand seven hundred and sixty.
