In the name of god amen the towe and twentieth day of december in the yeare of our lord god 1640 I Thomas Naylor thelder of Ashton in Makerfield in the parishe of winwicke in the county of lancaster and dyocesse of Chester glasier beinge sicke in bodie but of good and parfect memorie I praise my Lord god, yet knowinge death most certayne to all flesh but the houre and tyme thereof most uncertaine and for avoydinge of suits and contrvarsies which after my death might arise or growe amonghst my Children or other frends touchinge, such pore esteate as the lord hath endowed mee withall I doe ordayne make and apoint this my last will & testement in manner and forme followinge That is to saye first aboue all things I humblye Comend and Commit my soule unto the hands of Almightie god the father sonne & holy ghost three p[er]sons & one god in whome alone is my bodie I Com[m]it to the earth from whence it came & to bee buried at my p[ar]ishe Church of winwicke afforesaid theire to remane in the bosome of the earth untell it shall please my saviour and redeemer to raise it upp againe with a bodie of Imortalitie And concerninge such worldly goods and Cattels as god hath given mee the Custodie of they all shall bee devided as hereafter followeth, First it is my will and mynd that my deabts and funirall expences shall bee paid and discharged forth of my whole goods, And after my debts and funirall expences are discharged and paid, It is my will that the reste and resedue of my said goods shall be devided into towe equall p[ar]ts, The one p’rte thereof I give unto Ellen my wyffe and the other p[ar]te I give unto my Children Rodger Naylor Margret Potter and Elizebeth Higginson Itm it is my will and mynd & I give unto John Higginson my grand Child after my decease and my wiffes The hynde Croft the kilnars Croft and Ollivars Crofte and the milne Feild and alsoe the barne the shipon the steable and the kuilne the garden and the Croft backe of the barne with the leasses unto them belonginge Item it is my will that John Higginson shall paye when hee entreth upon the said premisses unto my sonne Rodger Naylor ten pownds To Margaret Pottar ten pownds To Elizebeth Higginson his mother ten pownds And to Robart Potter my grand Child five pownds and to the Children to bee begotten of the bodie of Margret Pottar equally to bee devyded e monghst them Itm it is my will and I give unto my sonne Thomas Children which I am now grandfather unto twentie five shillings when and att such tyme as that moneyes which I haue oweinge mee by my lord strange as will epeer by mr wins boocke of a Contits when it is receved the said legaesie to be devided equally emonghst them, unto Ellen Rodger Gilbart Margret and to Willm five shillilngs more Itm I ordaine and make Ellen my wyffe and Rodger my sonne my true and lawfull executors to execute and p[er]forme this my last will and testment accordinge to the true meaneinge thereof And I humbly desire and request the right wor’ll my good maister Sr Willm Garrard Barronet to bee sup[er]visor & ovarseear of this my will as my trust is in him to doe, In wittnes whereof I the said Thomas Nayler hath here unto put my hand and seale the daye and yeare a boue written/
