The will of Thomas Clemins:


In the name of God Amen I Thomas Clemins of the Borough of Warwick in the County of Warwick Rope Maker being of sound and disposing mind memory and understanding praise be therefore given to Almighty God for the Same Do make ordain this my last will and Testament in manner and Form following (that is to say) First and principally I recommend my Soul into the hands of Almighty God hopeing through the Merits death and passion of my Saviour Jesus Christ to have full and free pardon and forgiveness of all my sins and to Inherit everlasting Life and my body I commit to the earth to be decently buried at the discretion of my Executrix herein after named and as touching the disposition of all such Temporal Estate as it hath pleased Almighty God to bestow on me I do give and dispose thereof as followeth First I do give devise and bequeath unto my loving Wife Elizabeth Clemins during the term of her natural life all those my houses messuages or Tenements with all appurtenances to them belonging scituate and being in the said Borough of Warwick Item after the decease of my said Wife Elizabeth I do give devise and bequeath unto my Daughter Elisabeth Cooke and to her husband William Cooke their heirs or assigns those my three Messuages or Tenements with the appurtenances to them belonging scituate and being in a certain place or Street in the parish of Saint Marys in the said Borough of Warwick called Walldick now in the occupation of John Waters James Bradford and George Dean Item I do give and bequeath after my said wife decease ) to my Daughter Jane Cooke and to her husband George Cooke and to the heir of my said Daughter which shall or may be born of her body that my house Messuage or Tenement with all appurtenances to the same belonging scituate and being in a certain place or Street in the said parish of Saint Mary called West Street now in the Occupation of my Self and Joanna Bullimer they paying to my said Daughter Elisabeth Cooke out of the said messuage or Tenement the sum of Twenty pounds at the time of their entring into possession of the said messuage or Tenement as is herein before expressed and if my said Daughter Elisabeth should not be living (and having no living child born of her body) at the time herein before mentioned then my will is that no payment of the said Sum of Twenty pounds shall be made and further I do will that if it should happen that my said Daughter Jane dye without having any Child born of her Body and after the decease of her said husband George Cooke then I do give the said house or Tenement with all appurtenances to the same belonging to my said Daughter Elisabeth Cooke and if in case my said Daughter Elisabeth dye without any living Child born of her body then I do give the said house or Tenement with all appurtenances to the same belonging unto my Grandson Thomas Clemins Aktins and my GrandDaughter Mary Atkins to be equally divided between them share and share alike Item I do give unto my said Grandson Thomas Clemins Atkins after my said Wife decease those my two Messuages or Tenements with all Apurtenances to them belonging scituate and being in Walldick aforesaid now in the Occupation of Samuell Bromley and Mary Payn Item I do give unto my said Grand Daughter Mary Atkins after my said Wife decease my two other houses or Tenements with all Appurtenances to them belonging scituate and being in Walldick aforesaid in the said Borough of Warwick now in the Occupation of William Fell and Samuell Palmer and if in case that either of my said Grandson and GrandDaughter should happen to dye without having natural heirs of their Bodys lawfully begotten then I do give their two houses herein before bequeathed to each of them to the Survivour of my said Grand Children either of them so dying as aforesaid and if in case both my said Grandson and Grand Daughter should happen to dye without having natural Isue of their bodys as aforesaid then I do give the said four houses of Tenements with all appurtenances to them belonging as herein before bequeathed to them to my said two Daughters Elisabeth Cooke and Jane Cooke to be equally divided between them share and share alike each of them paying five pounds a piece out of the said premises one of the said five pounds to be paid to my Niece Hannah Clemins and the other five pounds to her Sister Mary Clemins my Brother Joseph Clemins two Daughters Item I do further will that all my said Children and Grand Children herein before named their heirs or assigns shall have free liberty to use a certain well and to go through a gate that is upon the premises of some of my said messuages in Waldick aforesaid without any hindrance or Molestation whatsoever and also that my said Children and Grand Children shall be at equall Charges to keep in repair or to repair the said well and Gate when need shall require when either or the said well or gate shall want to be repaired Item I do further give and bequeath unto my said Daughter Elisabeth Cooke the sum of ten pounds to be paid her by my Executrix out of my personal Estate two years after my decease Item I do further will that if my said wife Elisabeth shall or may have occasion for any money to pay my debts or any other charge that may fall out for her to pay I do will and impower my said wife to make chargeable all those my said messuages or Tenements by Mortgage for the Sum of Twenty pounds and no more and if the said sum of Twenty pounds or any part thereof with the Interest should be left unpaid at the decease of my said Wife then my will is that each of my said sons and Daughters and Grandchildren herein before named shall pay the said sum of Twenty pounds or any part thereof with the Interest that shall then be due and left unpaid share and share alike Item I do further will that if in case my said Wife should happen to Marry and have another husband then my will is that each of my said Sons and Daughters and Grand Children herein before named shall have and enter into possession upon all those my said houses messuages or Tenements herein before given and bequeathed to each of them they paying and alowing unto my said Wife the sum of Six pounds yearly and every year during the Term of her natural life and each of my said Sons and Daughter and Grand Children shall pay the said Sum of Six pounds by two even portion yearly as aforesaid equally between them share and share alike and if anyone of my said Sons and Daughters and Grandson and Granddaughter shall refuse and neglect to pay their part or share of the said Sum of Six pounds yearly as aforesaid then and in such case my will is that my said Wife shall and may reenter and take possession of any one or more of those my said Messuages or Tenements with the premises herein before bequeathed to either of them, and them detain and keep in her own possession untill they have paid their parts or share of the said yearly Sum of Six pounds that they have neglected to pay and when all dues is fully paid to my said Wife then my will is that the said Messuages or Tenements so forfeited shall be delivered up to the owner as they were before my said Wife being fully sattisfied and paid Item all and Singular the rest and Residue of my said personal Estate Goods and Chattel whatsoever I do give and bequeath unto my said Wife Elisabeth Clemins to be for her proper use and disposal for ever And Lastly I do hereby make nominate constitute and appoint my said loving Wife Elisabeth Clemins to be Sole Executrix of this my last will and Testament revoaking and disannulling all former and other will and wills by me at any time heretofore made In Testamony whereof I have to this my last will and Testament written upon two Sheet I have put my hand and seal this Twenty ninth day of January in the Twenty Seventh year of the Reigne of our Soveraigne Lord George the Second by the Grace of God of Great Britain France and Ireland King defender of the faith and so forth and in the year of our Lord One thousand Seven hundred and fifty four
