Thomas’s will


In the name of God Amen I Thomas Waring of Shipston upon Stower in the County of Worcester Farrier being of sound and perfect mind & memory blessed be God doe make & ordaine this my last will & Testam:t in mann:r following Impris I give & bequeath my Soul into the hands of Almighty God that gave itt trusting by the meritts Death & Passon of my Lord & Saviour Jesus Christ I Shall have & Enjoy Everlasting life & for my Body I com[m]it the same to the earth to be decently buried at the discretion of my Executrix hereinafter named & for the worldly Estate wherewithall it hath pleased God to bless me I give devise & Dispose of the Same in mann:r following (that is to say) Impris whereas I am entitled to one barne scituate & being in Shipston upon Stower aforesaid now in the occupation of John Hart which I hold by Lease for one & Twenty years from William Hired[?] gent: deced and:r [...] and covenants therein menconed & expressed & alsoe am entitled unto one oth:r barne Scituate in Shipston afores.d now in the occupacon of my Son Henry Waring & alsoe of in p[ar]te all those Severall rudges[?] or Sollier[?] of Land lying in the Fieldes of Shipston aforesaid reputed & taken to be the one halfe of one yard Land now in the occupation of my Son Henry Waring w:th said barne & halfe yard Land last menconed I hold & Enjoy by Lease granted to me from the Deane & Chapter of the Cathed:ll Church of Worc:r for the terme of one & twenty years und:r the Rents & Cover: in the said recited Indre menconed & reserv:d Item my will is I doe hereby give devise & bequeath the said two barnes & halfe yard land w:th th’app[ur]tenances unto my two Daughters Elianor Harris the wife of Rob.t Harris & Susannah Pittway the wife of Stephen Pittway & unto my two Sons Christoph:r Wareing & Steph:n Waring togeth:r w.th all Tenant right Customary right & right of renovacon of in & to the same To hold the Same unto them the said Elianor Harris Susannah Pittway Christoph:r Waring & Steph.n Waring their Exectrs Adm:rs & assignes for & During all the residue provid:ed. of the said termes of one & Twenty Years, & one & Twenty Years therein to come & unexpir’d und[er] the rents & Services due for the same to the intent that they my said two Daughters & two Sons their Exec:trs adm:trs & assignes may have an Equall right & Share in the same that no advantage Shall or may be tak.n by Survivour Lpp[?] or otherwise, & that they my Said two Daught:rs Shall take receive & enjoy their respective Shares of the Said p:rmisses & Dispose of the same from time to time without the consents of their respective Husbands as they Shall think meet & Soe as their said husbands may have nothing to do therewith: And my will furth:r is that if in case att any time hereaft:r my Said Daughters Elianor & Susana & my Said two Sons Christoph:r & Steph.n shall be minded to sell & Dispose of the Same p[re]misses that then the first off:r & refus[…] of the Same Shall be made to my Sonn Henry Wareing, & that upon paym:t of the Summe of one hundred & fourscore pounds of lawfull money of Great Brittaine for the purchase of the s:d p[re]misses they my Said Daughters Elianor & Susana & my Said two Sonns Christoph:r & Steph:n Shall assigne & transferre their title & terme of Years in the p[re]misses w:th all tenant right to the Same unto my Said Son Henry Wareing his Exe:trs adm:rs & assignes Upon this condicon that he my said son Henry shall not att any time after the said purchace see to be by him made sell or dispose of the said p[re]misses to any person or persons whatsoever otherwise than to his own brother & Sonns. Item I doe hereby give devise & bequeath unto my loving Freinds Joseph Wareing of Shipston aforesaid Brassier & Thomas Mister of the same Town Appothecarry & to the survivour of them & to the Exec:r & Adm:r of such Survivour All that my Messuage or Tenement & p[re]misses with thapptences scituate & being in Shipston upon Stower aforesaid now in the occupacon of my Son Henry Wareing which I hold by Lease from the Dean & Chapter of Worcester for the term of Forty yeares under certain rents & Coven:ts therein contained To hold to them the said Joseph Wareing & Thomas Mister & to the survivour of them & to the Exec:trs & Adm:rs. of such Survivour for & during the remainder of the said term of Forty yeares therein to come & unexpir’d To the intent & purpose that they the said Joseph Wareing & Thomas Mister & the survivour of them & the Exec:trs. & Adm:trs of such Survivour doe & shall permitt & suffer my said son Henry Wareing to receive & take the rents issues & proffitts of the said p[re]misses during soe many yeares of the said Term as he my said son shall happen to live & from & after his decease doe & shall permitt & suffer Ann the now wife of the said Henry Wareing to receive & take the rents issues & proffitts of the said p[re]misses during soe many yeares of the said term as shee shall happen to live if shee shall keep herselfe Sole & Unmarried & from & after the deceases of the said Henry Wareing & Ann his wife or such second Marriage of the said Ann doe & shall surrender & yeild upp the said Messuage or Tenemt with thappurtenances And the term & estate therein unto my Grandson Thomas Wareing the son of the said Henry Wareing & to his Exec:tr Admr & assignes t doe & dispose of the same as to my Grandson the said Thomas Wareing shall seem meete and my will further is that the person who shall be entitled to the rents & proffitts of the said p[re]misses att the time as the same ought to be renewed shall att their own proper costs & charges renew the said Lease & upon default of such renewall or of such second Marriage of the said Ann then my will is that the said Joseph Wareing & Thomas Mister & the Survivour of them & the Exec:r & Adm:r of such Survivour doe & shall permitt & suffer my said Grandson Thomas Wareing his Exec:tr Adm:tr & assignes to make such renewall & to take there[...] issues & proffitts of the said Messuage or tenem:t w:th theapp[ur]tenances during the remainder of the said Term to [...]their own use And my will further is that whatt renewall shall be made of the said p[re]misses or in what name or names soever the said Lease of the p[re]misses herein before menconed expressed & declared Item My will is & I doe hereby direct & appoint that my said Grandson Thomas Wareing his Exec:trs Adm:rs doe & shall within Six months next after he shall be in pos’ion or entitled unto the rents & proffitts of the said Messuage or tenem:t w:th thapp[ur]tenances pay or cause to be paid unto his two brothers William & Henry Wareing the sume of Five pounds apeice & I doe herby charge the said Messuage or tenem:t w:th the paym:t of the same Item I give & bequeath unto my daughter Sarah Morgan widdow the sume of Twenty pounds of lawfull money of Great Britaine Item I give & bequeath unto my Grandson Thomas Wareing of London Joyner Two Guineas Item I give & bequeath to my Grandaughter Elizabeth Arnold Two Guineas Item I give & bequeath unto my Grandaughter Ann Pope the wife of [blank] Pope of London weaver the sume of twenty pounds and my will & mind is & I doe hereby direct & appoint that the said sume of Twenty pounds soe given to my daughter Ann Pope shall be paid into the hands of the said Joseph Wareing & Thomas Mister by my Exex within Six Months next after my decease to be by them plac’d out att intrest in their own names or in the names of the survivour or in the name of the Exec:r Adm:r of such Survivour for the sole & sep[ar]ate use of my said daughter Ann Pope sep[ar]ate & apart from her said husband soe that he may have nothing to doe therewith and my will is that the intrest & increase of the said sume of Twenty pounds shall from time to tie be reced & paid by the said Joseph Wareing & Thomas Mister & the Survivour of them & the Exectr & Adm.tr of such Survivour to the hands of my said daughter Ann Pope & her Acquittance from time to time shall be a sufficient discharge for the Same and my will is that my said Trustees shall not be answerable for any loss that may happen in the putting & placeing out of the said sume of twenty pounds And my will is that my said Daughter Ann Pope shall & may be her last will & testamt. in writeing subscribed in the p[re]sence of two or more e[..erable] witnesses or by any other writeing in her life time testifyed as aforesaid give & dispose of the said sume of Twenty pounds & the intrest thereof to such person or persons as shee shall think fitt without the consent of her said husband Item I give & bequeath unto Elizabeth Pope daughter of the said Ann Pope the sume of tenn pounds Item I give & bequeath Unto my Grandaughter Ann Wareing daughter of Charles Wareing deced the sume of Five pounds All which said Legacyes my will is shall be paid by my Exex within Six months next after my decease And all the rest of my money bills bonds Chattells Cattle household stuffe of whatt nature or kind soever itt be & not hereinbefore particularly disposed of & after my debts & funerall charges & the reasonable expences & charges of my Exex in & about the execucon & proving of this my will is satisfyed & paid I give & bequeath unto my three sonns Christopher Wareing Stephen & Henry Wareing & to my Four daughters Elianor Harris Ann Pope Sarah Morgan & Susana Pitway equally to be devided between them share & share alike and I doe make & appoint my said daughter Elianor Harris Sole Exex of this my last will & testam:t hereby revoaking all former wills by me made And I doe desire my loving freinds Joseph Hunt of Shipton aforesaid gent & Rich Wareing of Shipton Malster to be Overseers of this my will & to be assisting to my Exex in the execucon thereof & I doe give to each of them halfe a Crown In Witness
