In the name of God Amen This nyneteeth day of March 1642 I John Payton the Elder of Dudley in the County of Worcester Yeoman being of good and perfect memory (praised be God) doe make this my last Will and Testament in manner and forme followinge First I give and bequeath my Soule into the handes of Jesus Christ my Saviour and Redeemer lookinge for eternall life and salvation in and through his mediacon and redempcon aloane And my bodie to the earth from whence it came And for those worldlie goodes wherewith it hath pleased God to blesse me I dispose of them as followeth First I give unto Margaret my wife fower of my best kyne or heifers as she shall chuse my mare & all the corne which shalbe growinge on the ground or [I...ed] in the Barne together with the haye on the ground or in the house and all my swine then being togeather with the mucke that shalbe made and all my houshold provision with my lynnens brasse and pewter and other my housholdstuffe dureing her life at her dispose And after her decease the same that shalbe remayning to be equally divided into 5 partes and to be distributed to my three sonnes Thomas John and Henry and to my two daughters Isabell Shawe and Ann Lee ratiably and proportionably to every one a like share at the discretion of my Executors & overseers herafter named exceptinge all the furniture in the hall wherein I now dwell and bords formes chaires stooles benches wainscott Linkes Garles and backstone as nowe they be belonginge to the hall And also exceptinge in the Parlor one joyned bedstead & cupbord and one chest there and one other Joyned bedstead and my Bible wich I give to John Payton my second sonne Item I give unto my eldest sonne Thomas Payton and the heires of his bodye forever all that burgage or Tenement with the appurtenances in Dudley situate and beinge in the horsefaire neare Russons Tenement nowe or late in the occupacon of William Corbett And all that my Leasowe meadowe or parcell of land with the house & appurtenances called Roseland Buddings which I purchased of Edward Davis of West Bromwech lyinge in the parishe of Rowley in the Countie of Staff And for want of such heires as aforesaid I will the same to John Peyton my second sonne and to the heires of his bodys forever yeildinge and payinge dureing the life of Margarett Peyton his mother her third yearelie out of the same Item I give unto my second sonne John Peyton and to the heires of his bodie forever the house with the appurtenances wherein I nowe dwell with all the barnes stables edifices and landes thereto belonging called Hoggridge or Tinsley Hall which I purchased of Humphrey Robbinson And for want of such heires as aforesaid I will the same to my eldest sonne Thomas Payton and to the heires of his bodye forever. Alsoe I give unto my second sonne John Payton all my waines plowes harrowes Chaines Tumbrells and all other implements of husbandrie whatsoever and one longe ladder yeilding and paying Dureing the life of Margarett his mother Five poundes yearelie (that is to saie) every quarter 25 s by even porcons And alsoe allowinge her the hall and chamber and a part of the garden Item I give unto my third sonne Henry Payton and to his heires forever one house or Tenement with the appurtenances in Dudley called Russons which I bought of Thomas Sherman with the houses barnes and backsides thereto belonginge now or late in the occupation of John Cookesey and John Southall And one acre of Land more or lesse in Canaryfeild wch I bought of Richard Inkes and one Longe Ladder yeilding and payinge dureing the life of Margarett his mother 40 s yearelie at every quarter etc by equall porcons Also I give unto my said sonne Henry one Lease which I bought of Gilbert Gillions of a burgage or Tenemt called Fishers with a Crofte and 2 acres of ground thereto belonginge And alsoe I give him one other Lease of a Close at Dixons ground under Canarye Hill And also one other Lease of 4 Closes called Hounds barne and one bedstead or xxs in money to be paid him by my Sonne John Payton Item I give unto William Underhill of Sutton my Sonne in Law xiid And also I give unto William his sonne my grandchild five shillings Item I give unto Margery Bradley my kinswoman one two yeare old heifer and twoe ewe sheepe Item I give unto the poore of both parishes of Dudley the sume of Tenne Poundes which I putt into the handes of John Payton my sonne to pay everie Easter five shillings And at every Christide five shilllinges forever to the use of the poore of both parishes aforesaid after my decease which shall first happen Item all the rest of my goodes and chattells remained and not before given & bequeathed Debtes paid and funeral expences discharged I give unto my 3 sonnes and two daughters before named equally betwixt them to be divided into severall partes as aforesaid And if either of my 2 Daughters dye before me my will is that her Children shall have her part as it happens to be Lastly I ordain and make Thomas Payton and Henry Payton my Executors of this my Last will & Testament And I utterlie revoake all former wills And I request William Bentley of Kingswinford and John Payton my sonne to be my overseers And doe give either of them for their payines ten shillings apiece John Peyton his marke Read Sealed and published as his last will and Testament in the presence Will Bendy Richard Amphlett Ge: Harrison Gilbert Gillinge Chris Wyreley


The will was proved at London the [blank] day of November in the yeare of our Lord God one thousand sixe hundred fifty five before the Judges for probate of wills and granting administrazons lawfullie authorized by the oaths of Thomas Peyton and Henry Peyton joynt Executors named in the last will and Testament of the said deceased To whom was granted administrason and They being first sworn by virtue of a Comission truly to administer
