Mortgage from Anselm Baily of Putley in Standish, co. Glos., yeoman, and Thomas Pearce of Gloucester, gentleman, to Joseph Browne of Woodchester, co. Glos., gentleman, of a messuage in Wheatenhurst, late in the tenure of Giles Dawby and now of James Kinge, closes and lands in Wheatenhurst (field-names and boundaries) in the tenure of the said James Kinge, and a cottage in the tenure of John Baily, for 200 years to secure £200.


Anselm’s will:


In the name of god amen the firste day of June in the first yeare of the Raigne of their Maties William and Mary king And Queene of England Scotland France and Ireland Deffenders of faith &c Annoque Dom. 1689 I Anselm Bayly of the p[ar]ish of Standish in the Countie of Gloucister yeoman being sick in body but of p[er]fect memory praised be god for it doe make and ordayne this my Laste will & Testament in manner and forme following first I bequeath my sowle into the hands of the Allmightie god hopeing that through the death and passion of jesus Christ to Recive Free pardon of all my sins And for my wordly goods which the lord of his mercy hath lente me I give And bequeath them as followeth


Imprimis I give and bequeath unto my daughter Sarah the sume of one hundred powndes to be issuing and Raised out of my Stock and the same to have when She shall Accomplish the age of three and twentie years and my will is that my stock shall pay of the morgadge which is one my land and in Case my stock will not rise and Amounte to pay the morgadge and my daughters portion then my daughter shall have one acre of arable land in broadfild to her and her Ayres for ever and my will is that if my stock Amounts to pay the morgadg and my dauter portion then the acre of land in Broadfild shalbe to my Sonn Anselm and his heirs for ever and alsoe I give to my daughter one bed and bedsteed with all it appurtinances thereunto belonging


Item I give and bequeath unto my Sonn Anselm Bayly one Mesuage caled by the name of Dabys howse and backsides and one close of pasture ground thereunto adjoyning called the home close three Acrs in the lower field and one Acre of erable land lying in homage the furthermoste being three ridges one acre of erable land lying in Little westfield all which sd p[re]mises are sittuate lying and being in Wheaten hurst in the Countie afforesaid to be had and holden to my sonn and his heirs for ever after the decease of my father and my wife if my wife continue unmarryed after my decease


Item I give and bequeath unto my Sonn William Bayly on messuag caled wildfier howse and garden and Close of ground therunto adjoining and the renession of hameisi house And one acre of erable land lying in Afild caled homage the nexte to my Sonn Anselm being three Ridges and one pasture ground caled by the name of Shearlock one littell medow caled the Ringe lying and being in Wheatonhurst aforesaid to him and his heirs for euer after the death of my father and wife as aforesaid


Item I give and bequeath unto my Sonn John Bayly one pasture ground caled hindhalings containing by estimation one Acre one pasture ground caled by the name of puckpitt by estimation three Acres one acre of erable land lying in Afild caled homage being six ridges & goores sittuate lying and being in Wheatonhurst aforesaid to be to my Sonn John and his heires for ever after the decease of my father and wife as Aforesaid


and further my will is that if any of my Children shall happen to dye before they come the theyre full age or be marryed that then his or her parte & portion soe dying shalbe equally devided Betwene the Reste of My children which are then Alive And my will and meanering is that after my decease and the decease of my wife my stock that then Remaine to be equally devided betwene my children which are then Alive


Item I give and bequeath unto my Father and to my wife All my lands and goods and stock of all sorts duering their natrell lives paying to my daughter her portion as above directed and alsoe to pay of the mortgadges as is above so by me directed And my will and meaning is that my wife shall have after the death of my father if shee survive him the power and inissuing of all my lands and goods but in case my wife shall happen to marry with any other man after my decease then my will is that my Children which are then alive shall have all my stock over and above paying my daughters portion and paying the mortgadge as afforesaid to be equally devided betwene them at such tyme of marage And I doe make and ordayne my daughter Sarah and my Sonne Anselm to be my executors of this my last will & testament And further I doe Appoynte my Father and my wife to be overseers of this my last will and testament and doe give them full power and Authority to sell of my stock to pay my daughter as aforesd and the mortgadge to the beste advantage at their discression In witness wherof I have heare unto sett my hand and seale the day and yeare firste above written /
