Disability Discrimination

To Whom It May Concern,

I am a person with a disability, because of this disability I am protected by Federal Laws. I am protected by the American Disability Act and employers must follow the guidelines and must be trained accordingly and act accordingly to what the federal laws states. Today, XXX discriminated me towards and I am going to explain in detail how this happened.

On January 18,2020 I was eating lunch at the HR Office. For the past 1 year and 2 months, I normally eat my lunch there. No one has said anything to me, no manager/Hr. Until recently, XXX discriminated against me and told me that I cannot eat there. I asked him why and he responded by saying, “ Because it is an office.” I explained to him that I have a disability and I can only eat where I won’t get distracted in somewhere peaceful.

While I was explaining it to him, XXX kept interrupting me and wouldn’t allow me to finish. After while of going back and forth, I explained

to XXX that it is within my rights as a person with a disability to ask for reasonable accommodations at any time during my employment. I

explained to XXX that if the employer does not comply with federal laws I will be forced to seek litigation. XXX replied, “ Is that a

threat ? ” I just decided to leave the office and spoke to XXX and I left home for the day.

Let me make this clear: The Federal Law states that, “ only has to say that they require you to provide them with an adjustment or change at work due to a medical condition.” Otherwise would violate the ADA if there were no reasonable accommodations in place. Therefore XXX has violated my rights because I was forced to be removed from where I was eating at and they did not provide me an alternative place to eat my lunch in a quiet area.

XXX used intimidation to make me try and understand his incorrect remarks. XXX is not knowledgeable of ADA rights not trained

correctly in trying to make reasonable accommodations to which he has failed and is in direct violation of the ADA.

The ADA states that , no person with a disability shall be discriminated against, harassed, retaliated, or intimidated in a working environment. Subject of these would be in violation and employer would be penalized for breaking such federal laws. To which there was No Undue Hardship for the employer or grounds for the employer to discriminate by not allowing me to eat there, when several employees have been seen eating at that table. XXX has failed to have an interactive process and didn’t even try to find reasonable

accommodation to meet my needs.

In Conclusion, I am deeply heartened that XXX and the company has treated me unfairly and has continuously discriminated against people

with disabilities in the workplace.
