韓国側が主張する”国際法的根拠”に、Scapin677号とScapin1033号により、韓国領土となったという歪曲主張がなされる。
Scapin指令によって、現竹島Liacnourt Rocksは日本の行政権から分離される事となった。それは鬱陵島の米第24軍団の管轄化に置かれた為である。 しかしながら、日本の外務省と、GHQのGSとの会談において、Scapin指令は領土主権を決定するものではなく、あくまで連合国軍の管轄行政権の話であり、日本領土の決定は、あくまでも対日講和会議、つまり後のサンフランシスコ平和条約であると明確に回答している。
2. 行政の分離に関する第一回会談録（終戦第一部第一課）
（昭和二十一年）二月十三日黄田連絡官GS「ロッヂ」大尉及び「プール」中尉と標記の件に関し第一回会談を行ひたり要旨左の如し
黄「本日は領土の歸屬問題乃至は本指令の妥当性等に付いては触れさることとし単に疑義に付質問を為さんか為参上せり」
米「本指令は単なる連合国側の行政的便宜より出てたるに過きす従来行はれ来りたることを本指令に依り確認せるものなり即ち其の他はSCAPの所管するところにあらす例えは大島はCINPACの所管。鬱陵島は第二十四軍団の指揮下に在り従って本指令に依る日本の範囲の決定は何等領土問題とは関連を有せす之は対日講和会議にて決定さるへき問題なり」 （注：CINPAC(Commander in Chief, Pacific : 太平洋軍最高司令官)
Scapin677にも、以下の注意書きがきちんと記載されている。
6. Nothing in this directive shall be construed as an indication of Allied policy relating to the ultimate determination of the minor islands referred to in Article 8 of the Potsdam Declaration.
また、1946年の06月22日のScapin1033に関してだが、 Scapin1033は、所謂マッカーサーラインの話で日本漁業及び捕鯨業の操業認可区域の指定の話であるが
(b) Japanese vessels or personnel thereof will not approach closer than twelve (12) miles to Takeshima (37°15' North Latitude, 131°53' East Longitude) nor have any contact with said island.
Scapinと同様、これは米国第24軍団の管轄権の話であり、最終的な日本の領土の決定でない事は、やはり同様に注意書きが付けられている。
5. The present authorization is not an expression of allied policy relative to ultimate determination of national jurisdiction, international boundaries or fishing rights in the area concerned or in any other area.
このScapin1033は、SCAPIN2046によって、Scapin1033のマッカーサーラインの廃止が決まる。
尚、SCAPIN2046ものパラグラフ6にも The present authorization is not an expression of allied policy relative toが記載されています。
3.さらに、このScapin指令が暫定的な物であり、領土問題の最終決定ではなく、最終決定は対日平和条約で決定されるというのは、次の文献からも確認ができます。

これらの見解と同様に、Scapin677によって、連合国が現在の竹島を韓国領土と決定したことは、一度もありませんでした。
これは、のちにも述べますが、戦後韓国が竹島を侵略してからも、再確認の過程で、韓国の主張するScapin677に基づく領有権主張は間違いであると明言しているのです。（1952.11.14.Confidential Security Information about Liancourt Rocks を参照）
つまり、韓国政府の主張は歪曲なのです。
