Since they were detained more than a year ago, the number of those initial child neglect charges has significantly increased. He is currently facing 30 similar accusations, including ones for child abuse and medical misconduct. However, the defendant's incarceration has damaged law enforcement's reputation in the circumstantial murder case. On Valentine's Day 2022, after then-defense lawyer Jeff Ambrose disclosed that police had unlawfully refused to provide Cory Bigsby with the sought attorney throughout the initial four days of the investigation.
During a heated dispute with a detective, the defendant twice begged for a counsel and was twice improperly chastised, according to WTKR, at which point then-Hampton Police Chief Mark Talbot acknowledged the officers' shortcomings in that area. "We have a responsibility of our own. Quite frankly, we fell short," admitted Talbot, who is currently the chief of the Norfolk Police Department. "In my opinion, his wishes ought to have been carried out, but they weren't.
Ambrose left the lawsuit in April 2022, claiming "an ethical conflict has arisen that prevents further representation." Amina Matheny-Willard assumed control of the defence team later that month. The police were accused of impeding justice, polluting the possible jury pool, and making statements that put the Bigsby family's life in danger. He promptly filed a cease and desist letter demanding that Talbot retract earlier public statements made in the case.
Days later, Talbot and the city responded, refusing to back down from any statements they had made, disputing the accusations, and accepting no responsibility. At least five times, Cory Bigsby's request for bail in the child negligence case has been rejected. On those allegations, an initial court date set for November 2022 has been vacated numerous times.

The Daily Press claims that the murder accusation and the defense's so far successful request for a mental competency examination, treatment, and concurrent pause in trial could both have been sparked by a cryptic statement made by the defendant while he was in custody.
Matheny-Willard had previously claimed that the prosecution purposefully took their time in giving the defence a transcript of the remarks. The state claims that they did nothing illegal because the comments were made in relation to the murder investigation and not the ongoing child abuse and neglect allegations, through Hampton Commonwealth attorney Anton Bell.
He said to WTKR on Friday, "The news is not a surprise to me." I pray that today marks the start of the grieving process for the family and those of us who are grieving for a child we never met. On June 14, a hearing will be held to determine how well Cory Bigsby's mental health care plan at Eastern State Hospital is working.
