Clinton Collins Incident Detail

The pole allegedly entered the victim's head below the jaw with force, exiting near the right temple, and caused significant injuries. Police in Tulsa moved quickly to arrest Collins and file a maiming charge against him. Officer Danny Bean compared the horrific incident to scenes from a horror film or television show as he described it.

He told 2 News that the attacker "ran at him and stabbed him through the head like you'd see in a TV show or a horror movie." "Went through the bottom and out the other side," he continued. Surprisingly, when the police arrived on the scene, the American flag was still fastened to the pole.

The fact that Tulsa firefighters had to cut a portion of the flagpole in order to safely take the victim inside the ambulance made the rescue effort difficult. Despite the severity of his wounds, there is some optimism because authorities predict that the victim will probably just lose one eye.

In Oklahoma, maiming is regarded as a serious felony offence that carries a sentence of up to life in prison. The authorities have not yet revealed the reason for this bizarre and brutal attack inside a fast food restaurant. Due to the offender being a member of the Muscogee (Creek) Nation, there have also been concerns about the case's jurisdiction. Whether his trial will take place in a tribal court or a US District Court is still up in the air.

The Supreme Court's judgement from 2020, which held that Oklahoma prosecutors lack the power to bring criminal proceedings against tribe citizens in a considerable area of eastern Oklahoma since it remains an American Indian reservation and encompasses the majority of Tulsa, is the cause of this ambiguity.

The Supreme Court's ruling from the previous year, however, permits Oklahoma to prosecute non-Native Americans for crimes committed on tribal grounds where the victim is Native American. The judicial actions in this uncommon and tragic situation have been made more difficult by these jurisdictional difficulties.
