Alexee Trevizo, and her lawyer, Gary C. Mitchell, appeared in an Eddy County court via Zoom for a pre-trial hearing to dismiss various motions and counter-motions that were recently filed in her case. The judge was loudly unpersuaded by the state's arguments and emphasised that there were no charges of domestic violence in the case. In case his client and the child's father "run into one another" unintentionally, Mitchell said he wanted the no-contact order changed or abolished. Therefore, under this rule, any statements made won't be protected by the doctrine of privilege.

The prosecutor further contended that a court order was used by police to lawfully collect the hospital's medical records. In the end, the court held out hope for both the state and the defence on the matter after recognising that New Mexico's patient-physician privilege can serve as a potent block to evidence.

I can't group this into one event, a protracted event," the judge remarked, adding that she would need more time to think over the matter following another round of briefing from both sides. On the other hand, Lane stated that a video showing Trevizo entering and exiting a lavatory in a hospital hallway is probably not privileged.
