According to the police department's press release, "Cummings gave inconsistent statements to responding officers and the scene was determined to be suspicious." Detectives started interviewing people, forensics started examining the crime scene, and the death was further looked into as a homicide.

In August 2012, the same events took place. Andy Trepcyk, who has since been adopted, was the first biological child of Cummings and was so badly shaken by the initial incident that he is now completely blind and suffers from a variety of other illnesses. At the time, Andy was 3 weeks old.

The Southern Pines Police Department told WFMY that the child is extremely fortunate to still be alive. According to WNCN, a CBS affiliate in Goldsboro, North Carolina, Cummings and Breanne Fowler, Andy Trepcyk's biological mother, were both facing child abuse charges at the time. The case took years to advance slowly before Cummings was apprehended in 2015 for beating and strangling a woman in a different instance.

In the end, the prosecution chose to combine the two cases, and they worked out a plea agreement with Cummings in which he admitted to assault and child abuse in return for a 45-day prison term and five years of probation. According to Allan Trepcyk, Andy Trepcyk's adoptive father, the Moore County District Attorney's Office, "the DA's position was that it was a hard case to try because neither defendant was saying much of anything,"

According to reports, Judge James Webb of the North Carolina Superior Court accepted the sentence in June 2016. In light of the most recent allegations, the adoptive parents of Cummings' younger biological kid recently spoke with WFMY. Andy Trepcyk's adoptive mother, Tracy Trepcyk, described him as a psychopath who is very manipulative. She attended Cummings' first court hearing on Tuesday along with her spouse."

I just felt like we needed to be here to advocate for our son because I don't feel that justice was properly served," Allan Trepcyk said. "In this instance, I don't want to minimise what occurred. They must battle for Andy because someone has to, even if I can't even begin to understand what they are going through. At the moment, Cummings is being held without bond in the Guilford County Detention Centre. He supposedly has a capital defence lawyer appointed to him.
