انضمام اقليم كوردستان العراق الى منظمة التجارة العالمية -الامكانية والتحديات القانونية- (دراسة تحليلية مقارنة)

Abstract

WTO allows the accession of separate customs territory, and the examples are Taiwan and HKSAR. The conditions for such accession are for the territory to apply a different tariff and to have freedom in its trade and trdae-related aspects. In this research we evaluated the possibility of accession of KRG to WTO through comparing Taiwan and HKSAR with KRG, and we found that KRG have the general requirements, with some obstacles in Iraqi constitution namely the exclusive authorities of the federal government which could be overcomed through narrow interpretation of the constitution, and other international obstacles such as the accession of a territory before the state itself, and the issue of diplomatic representation of a territoty in WTO.

الملخص

تسمح منظمة التجارة العالمية بانضمام الاقاليم المستقلة كمركيا الى المنظمة الى جانب الدول، والامثلة هي تايوان وهونغ كونغ وهما اقليمان تابعان لدولة الصين الشعبية. ويشترط لانضمام هذه الاقاليم ان يكون بامكانها فرض تعرفة كمركية مختلفة عن الدولة نفسها وان تتمتع بقدر من الحرية في علاقاتها التجارية والمسائل الاخرى ذات العلاقة بالتجارة. وفي هذا البحث درسنا امكانية انضمام الاقليم عن طريق المقارنة بين خصائص تايوان وهونغ كونغ مع الاقليم، ووجدنا ان الشروط العامة متوافرة في الاقليم، مع وجود اشكالية في الدستور العراقي تتعلق بالاختصاصات الحصرية للحكومة الفدرالية يمكن حلها بتفسير الدستور تفسيرا ضيقا، واشكاليات دولية تتعلق بمسألة انضمام الاقليم قبل العراق والتمثيل الدبلوماسي للاقليم في المنظمة وهي اشكاليات سياسية وليست قانونية.

رێكخراوی بازرگانی جیهانی ڕێگە دەدات ئەو هەرێمانەی لەڕووی گومرگییەوە ئازادن ببنە ئەندام، نمونەش ئەندامێتی تایوان و هۆنگ كۆنگە كە دوو هەرێمی سەر بە چینن. مەرجی ئەم ئەندامێتییە ئەوەیە ئەو هەرێمە گومرگی جیاواز لە خودی دەوڵەتەكە بسەپێنێ وە سەربەسی هەبێت لە پەیوەندییە بازرگانییەكانیدا وە لە بوارە پەیوەندی دارەكان بە بازرگانییەوە. لەم توێژینەوەیەدا لە ئەگەری بەئەندام بوونی هەرێمی كوردستانمان كۆڵیوەتەوە لەرێی بەراوردكردنی تایبەتمەندییەكانی تایوان و هۆنگ كۆنگ بە هەریمَی كوردستان، وە بۆمان دەركەوت هەرێمی كوردستان مەرجە گشتییەكانی ئەندامێتی تێدایە، لەگەڵ بوونی هەندێك ڕێگر لە دەستووری عێراقدا سەبارەت بە دەسەڵاتە حەصرییەكانی حكومەتی فدراڵی كە چارەدەكرێت لەڕێی لێكدانەوەی تەسك بۆ دەستور، وە ڕیگریی نێودەولەتیی كە كێشەی سیاسیین نەك یاسایی وەكو بەئەندام بوونی هەرێم پێش عێراق وە نوێنەرایەتی هەرێم لە رێكخراوەكە.
