Resolution #96-1

Whereas, the Sodaville City Council has reviewed and accepted the tentative proposal for lots and improvements within the proposed Baker/Gerig Northwest West View PUD and;

Whereas, the outstanding issues are:

  1. Off-development improvements which the Council may require of developers as a response to citizen concerns expressed at the last meeting.

  2. The phasing of the development and the phasing of required improvements.

  3. Changes to the Agreement which reflect Council decisions on items 1 and 2 above.

Now, therefore, the City of Sodaville resolves that the required developer’s improvements will be phased as follows:

Phase 1

A. The City of Sodaville deeds a 20 x 66 portion of Open Space Parcel of the West View PUD to Gerig/Baker for street ROW through lot line adjustment.

B. Gerig/Baker deed their designated open space parcel to the City for open space through lot line adjustment.

C. Gerig/Baker prepay 3 West View Special Area System Development Charges @ $1,20@ each to the Water Utility.

D. Plat the lot for existing home with temporary access easement for existing driveway.

Phase 2

A. Pioneer the entire roadway, including all ditchlines

B. Install all underground utilities, including water service connection lines (but not including meter boxes or valving.) Let City install in water trench along Maple Street, at no additional cost, piping to extend its gravity system.

C. Realign the intersection of St. Louis and West View Streets as a tee intersection and replace oil mat.

D. Install road crossing culverts at Maple Street and over open space and install 8" shale or crushed rock base over entire roadway.

E. Install street light stubs and street name and stop signs.

F. Construct any and all off-development improvements that may be required by the Council.

G. Apply gravel finish course to provide access to all Phase II Lots, including Lots 1, 16, 7, 8 from which the City Council will select both the Bond Lot and the Fee Lot.

H. Deed to the City one Bond Lot with all on-site improvements completed (septic, utilities and driveway).

I. Deed to the City one Fee Lot with all on-site improvements completed (septic, utilities and driveway).

J. Finish roadway base and finish courses within 6 months of Phase 2 platting.

K. Oil mat roadway within 12 months of Phase 2 platting.

Phase 3

A. Plat balance of lots in PUD.
