RESOLUTION 82-3

RESOLUTION PROVIDING FOR THE DATE AND MANNER OF HOLDING A CITY TAX BASE ELECTION IN THE CITY OF SODAVILLE, OREGON, ON THE 18th DAY OF MAY, 1982, FOR THE PURPOSE OF SUBMITTING TC THE LEGAL VOTERS OF SAID CITY THE QUESTION OF ESTABLISHING A NEW TAX BASS IN THE AMOUNT OF $1711.00 FOR THE PURPOSE OF APPLYING A LIMITATION OF TAXATICN SET FORTH IN SECTION 11, ARTICLE XI, IN THE CONSTITUTION OF THE STATE OF OREGON.

WHEREAS, the City Council of Sodaville has determined that it is necessary to establish a new tax base for the City of Sodaville in order to permit the proper operation of the City, and

WHEREAS, Section 11, Article XI of the Oregon Constitution provides that a city can establish a tax base at a state-wide general election and it is reasonable and necessary that a new tax base be established for the City of Sodaville

NOW, THEREFORE, IT IS HEREBY RESOLVED, that there shall be submitted to the legal voters of the City of Sodaville, Oregon at a tax base election to be held on the 18th day of May, 1982, the question of establishing a new tax base for the City. There is a state-wide primary election being held in the State of Oregon and within the City of Sodaville and as a part thereof on the 18th day of May, 1982 this tax base elction [sic] is called to be held concurrently therewith.

BE IT FURTHER RESOLVED, that at the tax base election there shall be submitted to the legal voters of the City of Sodaville, Oregon for their approval or rejection, the proposition in substantially the following form:

QUESTION:

Shall a new tax base of $1711 be established for the City of Sodaville effective for the 1982-83 year?

EXPLANATION:

The proposed operating budget for providing basic city services at the current level is $48,042. Of this amount, 3.5% would be financed by the tax base. The tax base revenues would be used exclusively for maintenance, reserves and debt service on the fire hydrants and related fire defense capabilities added to the municipal water system constructed in 1980. If the proposed tax base is established, monthly residential base rates for water use would be reduced by $2.00 a month from $10.00 to $8.00. The tax base in effect for the 1981-82 year is $410.00. The new tax base as proposed is authorized by Section 11, Article XI of the Oregon Constitution, and is eligible for up to 30% state tax relief program.

BE IT FURTHER RESOLVED that notice of election shall be given to the Linn County Clerk for publication as required by statute. The notice shall be substantially the following form:

Notice is hereby given that the City of Sodaville hereby call an election to be held on May 18, 1982, between the hours of 8:00 a.m. and 8:00 p.m. for the purpose of submitting to the qualified voters of the City the following question:

ESTABLISHING A NEW TAX BASE

QUESTION:

Shall a new tax base of $1711.11 be established for the City of Sodaville effective for the 1982-85 year?

EXPLANATION:

BE IT FURTHER RESOLVED, that the notice of the City tax base election shall be given by publication twice in the Lebanon Express, a newspaper of general circulation in the City of Sodaville, Oregon, not more than 30 nor less than nor less than 10 days before the election. Notices of the City tax base election shall be posted for not less than 30 days before the election in three public places within the city. The notice in the newspaper and that posted in three public places shall be substantially the same as the ballot measure.

BE IT FURTHER RESCLVED, that the City Recorder shall advertise and post or cause to be posted the notices required by this Resolution. The notices of the City tax base election required to be given above shall constitute the only notice necessary. It shall be unnecessary for either the City of Sodaville or any official thereof to furnish the legal voters at the City tax base election pamphlets containing either (a) the text of the proposition of (b) arguments in support of or in opposition to the proposition.

BE IT FURTHER RESOLVED, that the polling places for said election in the City of Sodaville shall be those designated by the Linn County Clerk for general elections; the poll books for base election; Clerk to serve the Judges and poll books adopted for Sodaville by the Linn County Clerk as the said election are hereby adopted as the poll books for the tax the Judges and Clerks of election appointed by the Linn County in Sodaville at said general election are hereby designated as Clerks of and for the City tax base election.

BE TT FURTHER RESCLVED, that the polls for the City tax base election shall be open from the hours of 8:00 a.m. to 8:00 p.m. on said day.
