97-01 Washington Street Vacation
ORDINANCE NO. 97 - 1
An Ordinance vacating the following described street, towit:
As described on Exhibit A, attached hereto and incorporated herein by reference.
WHEREAS, as a result of petition from abutting property owners, the City of Sodaville has initiated vacation proceedings for a portion of Washington Street right—of—way, as described on Exhibit A, attached hereto; and
WHEREAS, the Council for the City of Sodaville has conducted a public hearing on March 25, 1997, having duly considered the testimony of interested persons and the general public; and
WHEREAS, the City council finds that notice has been duly given, that the consent of the owners of the requisite area has been obtained, and
WHEREAS, the City Council has determined that the public interest will not be prejudiced by the vacation of such portion of Washington Street right-of-way;
WHEREAS, the City Recording Officer has filed with the Recorder of Linn County, Oregon, a certificate showing that all city liens and all taxes have been paid on the lands covered by the portion to be vacated;
NOW, THEREFORE, the people of the City of Sodaville do ordain as follows:
Section 1.
A portion of Washington Street right-of-way, more particularly described on Exhibit A, attached hereto; is hereby declared vacated, with the following reservation:
Section 2.
A certified copy of this Ordinance vacating described portion of Washington Street right-of-way on Exhibit A on any map in regard thereto shall be filed for record with the County Clerk for Linn County.
Section 3.
A certified copy of this ordinance shall be filed with the County Assessor and the County Surveyor for the County of Linn.
Section 4.
Inasmuch as the provisions of this Ordinance are necessary for the immediate preservation of the peace, health, and safety of the people of the City of Sodaville, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect immediately upon its passage by the Council and approval by the Mayor.

VACATION DESCRIPTION FOR A PORTION OF WASHINGTON STREET FOR ORDINANCE 97-1
Beginning at a point on the east right-of-way line of Washington Street (a 66.00 wide right-of-way), said point being the northwest corner of Lot 3, Block 4 of "PRICES ADDITION TO SODAVILLE", a subdivision of record in Linn County, Oregon; thence South 01°42'30" West, along said east right-of-way line, 249.20 feet to a point on the arc of a 45.OO foot radius curve; thence along said arc of a 45.00 foot radius curve to the left (chord bears North 75°39'23" West 23.57 feet) a distance of 23.85 feet; thence North 01°42'30" East 99.04 feet; thence North 88°17'35" West 20.OO feet, thence south 01°42'3O" West 104.74 feet to a point on arc of said 45.00 foot radius curve; thence along said arc of a 45.00 foot radius curve to the left (chord bears South 32°04'28" West 45.50 feet) a distance of 47.70 feet to a point on the west right-of—way line of said Washington Street, which point being South 01°42'30” West 289.00 feet from the northeast corner of Lot 1, Block 3 of said "PRICES ADDITION TO SODAVILLE"; thence North 01°42'30" East 289.00 feet to said northeast corner of Lot 1; thence South 88°17'3O" East 66.00 feet to the Point of Beginning. Containing 0.33 acres of land, more or less.
