93-03 Property Purchase

RESOLUTION NO 93_03

WHEREAS: The City of Sodaville needs to Prove and construct a backup well for its municipal water system, and

WHEREAS: A portion of Tax Lot 1002 12-1W-31 Linn County, Oregon abutts the north boundary of the City of Sodaville Water Works (storage and control facilities), and

WHEREAS: The area of Tax Lot 1002 described below by Jim Udell, City Engineer would provide the necessary setbacks for the proposed well;

Beginning at a 5/8" iron rod at the Initial Point of West View Development Addition to the City of Sodaville in the Southwest 1/4 of Section 31 in Township 12 South, Range 1 West of the Willamette Meridian in Linn County, Oregon; thence South 89°29'12" Bast 245.91 feet to a 5/8" iron rod at the Westerly right-of-way, line of the B.P.A. powerline easement; thence North 4°58’35" West (North 4 40°58" West by prior record) 145.66 feet; thence North 89 29°12" West 177.47 feet; thence along a 117.39 feet radius curve to the left 137.74 feet (the long chord of which bears South 25°18'27" West 129.95 feet); thence South 0930'48" West 27.00 feet to the point of beginning

and,

WHEREAS: Edward R. Gaylord Jr., the Owner of Tax Lot 1002, has offered to sell the afore described portion to the City of Sodaville for $11,000, contingent upon the City proving a well to its specifications, and

WHEREAS: Edward R. Gaylord Jr. stipulates the following:

  1. Grants the City and State Health Division permission to enter the parcel to drill and test a water well;

  2. In the event the well does not prove out, the City must remove all drilling spoils and plant shrubs around the capped well.

  3. The sale must be consumated by March 31, 1994.

NOW THEREFORE BE IT RESOLVED THAT THE CITY OF SODAVILLE:

  1. Purchase the described area within Tax Lot 1002 for the sum of $11,000, contingent upon the City of Sodaville successfully drilling a well on the subject property which will:

a. Yield at least 25 gpm throughout a 48 hour well test.

b. Extend no deeper than 300 feet.

c. Meet all current Federal and Oregon drinking water regulations for a groundwater source.
