RESOLUTION NO. 21-09

RESOLUTION AUTHORIZING THE CHANGES TO THE TITLE OF “CITY ADMINISTRATOR” TO “CITY RECORDER” AMENDING ORDINANCE NO. 12-01

Whereas, the title of “City Administrator” has changed to “City Recorder” and the position of “City Administrator” no longer exists.

Whereas, Ordinance NO. 12-01 CITY OF SODAVILLE COUNCIL RULES AND PROCEDURES states,

SECTION 2. THE MAYOR AND COUNCIL,

2.4 Presiding Officer.

The Mayor shall be the presiding officer and conduct all meetings, preserve order, enforce the rules, and determine the order and length of discussion on any matter before the Council, subject to these rules. The Council President shall preside in the absence of the Mayor. The Presiding Officer shall not be deprived of any of the rights and privileges of a Councilor. In case of the absence of the Mayor and the Council President, the City Administrator shall call the meeting to order, and the Council shall elect a chairperson for the meeting by majority vote.

SECTION 3. COUNCIL MEETINGS,

Executive sessions may be held by the Council pursuant to ORS 192.640,650,660 and 670. Only those staff members required to attend will be present. Normally the City Administrator is required to attend.

3.9 Attendance.

Councilors shall inform the Mayor or City Administrator as soon as practical if unable to attend any Council meeting. The Mayor will inform the Council President and City Administrator if unable to attend any Council meeting.

SECTION 4. AGENDA AND OREDER OF BUSINESS,

4.1

An agenda for each regular Council meeting shall be prepared by the City Administrator. The Mayor or the City Council may direct that specific items be included on the agenda. The City Staff shall be given enough time to do necessary research or prepare necessary reports to address the agenda items. Agendas and informational material shall be distributed to the Council at least four business days prior to each regular meeting.

SECTION 9. COUNCIL RELATIONS WITH CITY STAFF,

9.6 Legal Advice.

Requests to the City Attorney for advice shall not be made by a Councilor except with the concurrence of the majority of the Council present in person or by speaker phone. The City shall not accept financial responsibility for any legal requests to the City Attorney made by private citizens. Before requesting research or other action by the City Attorney, the Council is encouraged to consider consulting with the City Administrator to ascertain whether the request of action can be accomplished more cost-effectively by alternate means. Outside a Council meeting, a Councilor should make requests of the City Attorney through the City Administrator or the Mayor.

9.7 List of Items to be Done.

The City Administrator shall keep a written running list of all actions to be done as determined by the Council during Council meetings. The list shall include "What is to be done, by whom, by when, what has been done and when" and be always available during and between meetings.

Whereas, Ordinance NO. 12-01 CITY OD SODAVILLE COUNCIL RULES AND PROCEDURES states,

SECTION 12. SUSPENSION OR AMENDMENT OF COUNCIL RULES

12.1

Amendments, deletions or additions to these Council Rules shall be by Resolution and approved by the City Council.

NOW, THEREFORE, BE IT HEREBY RESOLVED THAT:

The Sodaville City Council approves of the title of “City Administrator” to be amended to “City Recorder” on Ordinance NO. 12-01.
