ORDINANCE NO. 00-04
AN ORDINANCE VACATING A PORTION OF A ROCK ST.
WHEREAS, on August 22, 2000, pursuant or Oregon State Statute #271.080, upon receipt of written request from abutting property owner, the City of Sodaville has initiated proceedings to vacate a portion Rock Street, more particularly described in Section I of this ordinance and shown on the attached as Exhibit “A” to this ordinance; and
WHEREAS, notice of a public hearing regarding the proposed vacation to be held on Tuesday August 22, 2000, at 7:30 pm in the Council Chambers, City Hall, Sodaville, Oregon, was published in the Lebanon Express, a newspaper of general circulation in the City; and
WHEREAS, such public hearing was duly held at the mentioned time and place, and all persons desiring to be heard on said matter were heard;
NOW, THEREFORE, THE CITY OF SODAVILLE ORDAINS AS FOLLOWS:
Section 1:
That portion of Rock Street more particularly described as follows, is hereby vacated:
A 198 x 66 foot parcel of land being a portion of Rock Street lying between Block 7 and Block 12 of the Summers Addition, Township 12 South Range 2 West Section 36 AD, as recorded in the Book of Plats Linn County, Oregon.
Section 2:
A certified copy of this Ordinance vacating the described street shall be filed for record with the County Clerk, County Assessor and County Surveyor for the County of Linn.
Section 3:
Inasmuch as the provisions of this Ordinance are necessary for the immediate preservation of peace, health and safety of the people of the City of Sodaville, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect immediately upon its adoption by the Council and the Mayor.
