No 8 Street Vacation

53-H–A Bill for an Ordinance to be designated as

ORDINANCE NO. 8

Accepting and affirming representations of petitioners for vacation of St. Louis and Seminary Streets; granting requested vacation; and accepting on behalf of the City permanent easement over a 30 foot strip of land south of and of equal length of Seminary Street; and declaring an emergency.

The City of Sodaville Ordains as follows:

Section 1.

Representations of petitioners for vacation of St. Louis and Seminary Streets in Seminary Addition, CIty of Sodaville, are by this section accepted and affirmed.

Section 2.

St. Louis and Seminary Streets, from the western terminus thereof to the extreme eastern boundary of the City of Sodaville as it appears in Seminary Addition, are by this section declared vacated as prayed by petitioners, and title to the vacated areas attach to the lords and lands bordering thereon, as by law provided.

Section 3.

Permanent easement granted by the Board of School District 13 to the City of Sodaville, over and along a strip of land 30 feet in width and immediately adjacent to and bordering on the south line of the vacated area of Seminary Street, from the eastern line of Market Road No. 31 to the ultimate eastern limits of the City of Sodaville, as it appears in Seminary Addition, is by this Section accepted.

Section 4.

An emergency is declared to exist and this ordinance shall take effect and be in full force immediately upon its passage and approval by the Mayor in accordance with the provisions of Sections 35 and 36, Chapter VIII, of the Municipal Charter of Sodaville.
