No 52 Annexation

ORDINANCE 52

AN ORDINANCE RELATING TO ANNEXATION OF LAND CONTIGUOUS TO THE CORPORATE LIMITS AND BOUNDARIES OF THE CITY OF SODAVILLE, OREGON REPEALING ORDINANCE 51 AND DECLARING AN EMERGENCY.

The City Council of the City of Sodaville is considering annexing the land described in this ordinance pursuant to ORS 222.750. These lands are contiguous to the corporate limits and boundaries of the City of Sodaville and the described lands are not an incorporated city. The City Council finds that it is in the best interest of the residents and inhabitants of the City that submitting this question of annexation to the registered voters of the City is dispensed with and that a hearing be set at which the registered voters of the City may appear before the Council to be heard on the subject of this annexation. Accordingly and pursuant to ORS 222.750;

THE CITY OF SODAVILLE ORDAINS AS FOLLOWS:

Section 1.

Submitting the question of annexation of the real property described in this ordinance to the registered voters of the City of Sodaville at an election is dispensed with. In place of such an election, the City Council will hold a public hearing at a special meeting in the Council Chambers of the Sodaville City Hall, in Sodaville, Oregon on December 29, 1979 at 8:00 a.m. At that hearing the registered voters of the City may appear to be heard on the subject of annexing to the City the following described real property situated in Linn County, Oregon:

Section 2.

The City Recorder shall give notice to the registered voters of the City of Sodaville that the public hearing will be held at that time and place for that purpose. That notice shall be published in the issues of the Albany Democrat Herold [sic] for two successive and consecutive weeks, a total of three publications, prior to the date of that hearing and shall be posted in two public places within the City for the same period.

Section 3.

Ordinance No. 51 is hereby repealed.

Section 4.

The general welfare of the public will be promoted if this ordinance takes effect immediately; therefore, an emergency is declared and this ordinance shall take effect immediately upon its passage by the Council and its approval by the Mayor.
