89-03 Vacation

ORDINANCE No. 89-3

An Ordinance vacating the following described ally, to-wit: As described on Exhibit 5, attached hereto and incorporated by reference.

FINDINGS:

0n the 2bth day or February, 1989, the City Council of the City of Sodaville declaring an emergency between the readings of said ordinance at 7:30 Pacific Standard Time, hearing all protests and remonstrances as to the proposed vacation of the above described alley passed this Ordinance 89-3.

Notice was duly and regularly given of the hearing and at said time and place the Council heard all objections

All persons owning property abutting the alley to be vacated having consented to the vacation and applied for the same.

THE CITY OF SODAVIL LE DOES ORDAIN AS FOLLOWS:

Section 1.

The City Council of the City of Sodaville finds that due and regular notice of the hearing was posted as required by law, and no valid objections have been made or filed . The the public interest will not be prejudiced by the vacation of said alley.

Section 2.

The hearing was held on the 28th day of February, 1989 at 7: 30 P.M. at Sodaville, Oregon, and al I matters necessary to be done in the premises have been duly and regularly complete

Section 3.

The hereinabove described alley is hereby vacated, and the alley so vacated shall revert pursuant to statutes of the State of Oregon.

Section 4.

The City Recorder is hereby directed to file a certified copy of this Ordinance with the Recorder of Linn County, Oregon, together with a map or plat of said property, and a certified copy of this Ordinance shall be filed with the Linn County Assessor and another certified copy shall be filed with the Linn County Surveyor.

EXHIBIT A

Vacation Description for Ordinance 89-3

That portion of Seminary Street lying South of and adjacent to the South boundary of Seminary Addition to the Town of Sodaville, Linn County, Oregon; more particularly described as follows:

Beginning at the Southwest corner of said Seminary Addition as recorded in Book 3, page 33, Book of plats, Linn County, Oregon; running thence North 89°58' East on the boundary of said Addition, 511.50 feet; thence South 0°55' East, 26.00 feet to the Northeast corner of that certain tract of land conveyed to the Sodaville School District No. 13 in Volume thence South 89, page 508, Linn County Deed Records; thence South 89°58' West, on the North line of said School District No. 13 tract, 511.50 feet; thence North 0 55' West, 26.00 feet to the point of beginning. EXCEPT THAT portion of the above described property lying in Market Road NO. 31 (Sodaville Road).
