82-14 Property Trade

RESOLUTION NO. 82-14

A RESOLUTION INDICATING THE SODAVILLE COMMON COUNCIL'S INTENT TO TRADE LOT 2 BLOCK 7 FOR LOT 4 BLOCK 7 IN THE CITY OF SODAVILLE.

WHEREAS, the City of Sodaville owns Lot 2 Block 7 in the City of Sodaville and,

WHEREAS, said lot is currently inaccessible from Washington or Alder Streets and,

WHEREAS, said lot is sloped 20% and has no utility to the City and,

WHEREAS, John and Wilda Howard owners of the remaining five lots on Block 7 in the City of Sodaville have offered to trade Lot 4 Block 7 with the City to provide additional parking for the Park and,

WHEREAS, Lot 4 Block 7 in the City of Sodaville has been leveled, has a driveway access with culvert to Washington Street and is located across Washington Street from the picnic area and,

WHEREAS, the current City lot Lot 2 is theoretically buildable because it existed before the 1980 zoning ordinance but is technically unbuildable because of slope and,

WHEREAS, a trade would not result in a change of zoning status, as the number of under-deminsion [sic] lots would not increase and,

WHEREAS, Lot 4 Block 7 in the City of Sodaville would be buildable both in terms of zoning and slope if sewer were ever available and,

WHEREAS, the lots in question are of equal size and,

WHEREAS, the present value of both lots are less than the price of dual appraises

NOW THEREFORE BE IT RESOLVED that the City of Sodaville concludes that appraisals may be dispensed with as the lots are of equal size, on the same block, of low current value and the potential City uses of Lot 4 are clearly superior to those of Lot 2 and,

BE IT FUTHER RESOLVED that the City of Sodaville accept John and Wilda Howards offer to trade Lot 2 Block 7 for Lot 4 Block 7 in the City of Sodaville and,

BE IT FURTHER RESOLVED that the City of Sodaville as a condition of the exchange of lots, dedicated any futher [sic] revenues from the use or sale of Lot 4 Block in the City of Sodaville to improvements to the Mineral Spring Park or the Spring Hall.
