RESOLUTION NO. 21-02

RESOLUTION DESIGNATING THE POSITION OF PUBLIC WORKS DIRECTOR BE UNDER THE CITY ADMINISTRATOR'S AUTHORITY AMENDING RESOLUTION NO. 11-08

Whereas, the Public Works Director is a Sodaville City staff position.

Whereas, Ordinance #08-02 CITY OF SODAVILLE COUNCIL RULES AND PROCEDURES states, Section 9. COUNCIL RELATIONS WITH CITY STAFF, #9.2 No Individual Councilor or City Council Subcommittee has Authority over the City Staff.

Whereas the prior City Administrator and the Public Works Director were married, and there were potentials for perceived or actual conflicts of interest, and the City Council found that it was inappropriate for family members to have a supervisorial relationship, and that it is a situation not anticipated by the ordinance;

Whereas the City Council found that at that time, employing both the City Administrator and the Public Works Director was in the best interest of the public;

Whereas, this resolution shall only apply until such time as the City Council fully discusses and deliberates amending the ordinance to deal with the current employment situation and any similar circumstances that may arise in future employment;

NOW, THEREFORE, BE IT HEREBY RESOLVED THAT:

The Sodaville City Council places full authority on the City Administrator of Sodaville to supervise, oversee, and advise the Public Works Director. Furthermore, any schedule, hours of work, wage, benefits or stipends will be decided by vote of the majority of the Sodaville CIty Council in open session.
