No 40 Charter Election

ORDINANCE NO. 40

AN ORDINANCE RELATING TO A SPECIAL MUNICIPAL ELECTION TO BE HELD September 18 , 1979, DESIGNATING POLLING PLACES FOR THE ELECTION, DIRECTING THE CITY RECORDER TO APPOINT ELECTION BOARDS FOR EACH POLLING PLACE, DIRECTING THAT NOTICE OF THE ELECTION AND PUBLICATION OF THE MEASURE TO BE VOTED UPON BE GIVEN AND DECLARING AN EMERGENCY.

The city of Sodaville ordains as follows:

Section 1.

A special election is ordered and called in the city of Sodaville, Oregon, for the purpose of voting upon amendments to the charter of the city of Sodaville, Oregon. The amendments include an amendment that provides for the issuance of "1979 water bonds" in the amount of $130,000.00 as proposed and submitted by the city council to the legal voters of the city by a resolution of the council adopted earlier at its meeting on August 13 , 1979. An additional amendment provides for the increasing of the debt limitation from $5,000.00 to $150,000.00 as proposed and submitted by the city council to the legal voters of the city by a resolution of the council adopted earlier at its meeting on August 13, 1979 . The ballot title for each of these amendments is as follows:

Section 2.

That special election shall be held on Tuesday 1 September 18 , 1979, beginning at 8:00 A.M. and continuing until 8:00 P.M. on the same date without closing the polls. The election shall be conducted and the votes thereafter counted, canvassed, and returned in the manner provided in the charter of the city of Sodaville for elections.

Section 3.

The voting and polling precinct is designated for that special election as follows: Crowfoot Baptist Church 699 Cascade Drive, Lebanon, Oregon, Linn County.

Section 4.

The city recorder shall appoint election board or boards for each of the voting and polling places in the manner provided by law.


Section 5.

The city recorder shall give notice of this special election but publishing in the Lebanon Express the official newspaper of the city of Sodaville 30723 Sodaville Rd., Lebanon, Linn County, Oregon. The notice shall state the measure to be voted upon at the election, the ballot title thereof, the voting and polling places designated for the election and the date and time of the election.

Section 6.

It is necessary to hold the election for the submission of this charter admendment [sic] as soon as possible so that the necessary projects may be commenced, necessary budgets may be drawn, and necessary services may be afforded to the public. To this end, it is necessary that this ordinance become effective immediately in order to preserve peace, health and safety of the city of Sodaville. Accordingly, An emergency is declared and this ordinance shall become effective upon its approval by the mayor.
