ORDINANCE 80-05

AN ORDINANCE RELATING TO ANNEXATION OF PROPERTY CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF SODAVILLE, OREGON, AND DECLARING AN EMERGENCY.

On March 8, 1980 at 8:00 AM in the Council chambers of the City Hall in the City of Sodaville, Oregon, the City Council held a public hearing concerning the annexation of the property described in this ordinance. The City Council has determined that the proposed annexation of the property described in this ordinance. The City Council has determined that the proposed annexation is in the best interest of the City of Sodaville and its inhabitants and has reviewed and adopted the Findings of Facts contained in this ordinance. The City Council has also determined that the requirements of ORS 222.170 have been fulfilled. Accordingly:

THE CITY OF SODAVILLE ORDAINS AS FOLLOWS

Section 1.

The findings of Fact contained in Exhibit "A" attached hereto and by this reference incorporated herein are adopted.

Section 2.

The following described property contiguous to the City of Sodaville, Linn County, Oregon is annexed to the City of Sodaville:

Beginning in the Southeast corner of the city limits of Sodaville said point being 1386 ft. south of the southeast corner of Block 16 of Summers Add. to Sodaville; thence from said Southeast corner on the city boundary, East 870 ft. more or less to the Westerly boundary of the Bonneville Power Administration R/W line; thence in a Northwesterly direction along said R/W 716.4 ft. more or less to a point South 469.79 ft. from the North line of the K. Burge D.L.C. #58; thence West 820 ft. more or less to the present East line of city limits at a point South of the East line of city limits at a point South of the East line of Summers Add. to Sodaville; thence South along the East line of the city limits 715 ft. more or less to the place of beginning.

Section 3.

WHEREAS, The [sic] City of Sodaville is in the process of engineering a water system to which petitioners wish to connect, and to which petitioners wish to donate land for well and storage tanks, and water service can only be provided to and constructed on properties within the City, now Therefore, an emergency is hereby declared to exist and this ordinance shall immediately go into force and effect upon its adoption and approval.
