No 23 Streets

ORDINANCE #23

AN ORDINANCE REGULATING THE USE OF STREETS IN THE CITY OF SODAVILLE BY TRUCKS AND HEAVY VEHICLES AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND DECLARING AN EMERGENCY.

The people of Sodaville do ordain as follows:

Section 1.

It shall be unlawful for any person, firm or corporation to use, , drive or operate any vehicle weighing 20,000 pounds or more on any street of Sodaville City, Oregon. Linn County ,except the folloeing [sic] streets and avenues which are hereby designated as City Truck Route Streets: Market Road 31 & Main Street to Washington thence two blocks south, thence East on Maple.

Section 2.

Any such motor vehicle, truck trailer or other vehicle if used for specific purpose of picking up or discharging goods at any business establishment or residence located on other than the above named streets or Avenues, or if any such vehicle is being driven to the drivers residence for the purpose of parking overnight, shall be excempt [sic] from the provisions of this ordinance.

Section 3.

The Chief of police and city manager are hereby authorized to cause notice of such routes and use to be posted an any street or avenue within city of Sodaville to carry into effect the purpose of this ordinance.

Section 4.

Any and all ordinances and parts of ordinances in conflict with this ordinance shall be and the same are hereby repealed.

Section 5.

Any person violating any of the provisions of this ordinance shall be quality of misdemeanor and upon conviction thereof shall be punished of not less than $5.00 or more that $100.00 and in default of such fine shall be imprisoned in jail one day for each 2.00 of such fine.

Section 6.

It is hereby adjudged and declared that existing conditions are such that this ordinance is necessary for the preservation of public peace, health and safety, and an emergency is hereby declared to excist [sic], and this ordinance shall take effect and be in full force and effect from and after its passage and approval by the Mayor and Council.
