ORDINANCE 81-7

AN ORDINANCE RELATING TO THE EXTENSION OF THE URBAN GROWTH BOUNDARY OF THE CITY OF SODAVILLE, OREGON, AND RELATING TO THE ANNEXATION OF LAND COTNIGUOUS TO THE CORPORATE LIMITS AND DECLARING AN EMERGENCY.

The City Council of the City of Sodaville is considering annexing the land described in this Ordinance pursuant to ORS 22.750. This land is not within the urban growth boundry [sic] but is contiguous to the corporate limits. The City Council finds that it is in the best interest of the residents and inhabitants of the City that submitting this question of including the properties within the urban growth boundry [sic] and annexation to the registered voters of the City is dispensed with and that a hearing be set at which the registered voters of the City may appear before the Council to be heard on the subject of inclusion of the described properties within the City's urban growth boundry sic] and the subject of annexation of said properties to the City. Accordingly and pursuant to ORS 222.750.

THE CITY OF SODAVILLE ORDAINS AS FOLLOWS:

Section 1.

There shall be a public hearing held at a regular meeting in the council chambers of the Sodaville City Hall in Sodaville, Oregon, on the 11th day of December, 1981, at 8pm, to consider the possible inclusion of the following described properties into the City of Sodaville urban growth boundry [sic]:

A. Beginning at the Northwest Corner of that certain tract of land conveyed in MF9, page 389, Linn County Deed Records; said Corner being 5.17 Chains South of the Northeast corner of Block 21, in Summer's Addition to the Town of Sodaville, Linn County, Oregon; running thence S.1°26'W. 32.50 Feet from the Southwest Corner of Block 17 of said Addition; thence continuing S.1°26'W., along the said city limits 850.91 feet to the South line of Parcel I in MF272, page 130; thence N.89°58'E., 825.50 Feet, more or less, to the West right of way line of the B.P.A. Powerline; thence N.4°58'33'W., along the said West right of way line 653.20 Feet, more or less, to the South line of County Road #732; thence N.75°41'30"W., along the South line of said County Road 414.56 Feet to the East line of the Thomas Summers D.L.C. #56; thence N.O°14'W., along the East line of said D.L.C. 91.29 feet to and 3/4" Iron pipe; thence continuing N.O°14'W., along the East line of said D.L.C. 929.30 Feet to the North line of that certain tract of land conveyed in said MF9, page 389, Linn County Deed of Records; thence, 330.00 feet, more or less to the point of beginning.

B. Lot 8, Ramac Acres, Linn County, Oregon.

Section 2.

Submitting the question of annexation of the real property described in this Ordinance to the registered voters of the City of Sodaville at an election is dispensed with. In place of such an election, the City Council will hold a public hearing at a regular meeting in the Council Chambers of the Sodaville City Hall, in Sodaville, Oregon, on the 11th day of December, 1981 at 8pm. At that hearing the registered voters of the City may appear to be heard on the subject of annexing to the City the following described real property situated in Linn County, Oregon:

Section 3.

The City Recorder shall give notice to the registered voters of the City of Sodaville that the public hearing will be held at that time and place for that purpose. That notice shall be published in the issues of the Albany Democrat-Herald for two successive and consecutive weeks, a total of three publications, prior to that date of that hearing and shall be posted in four public places within the City for the same period.

Section 4.

The general welfare of the public will be promoted if this Ordinance takes effect immediately; therefore, an emergency is declared and this Ordinance shall take effect immediately upon its passage by the Council and its approval by the Mayor.
