IN THE MATTER OF THE TRANSFER)

CITY ROAD TO THE COUNTY OF )

The City of Sodaville having initiated a proceeding for the transfer of jurisdiction of a certain city road within the City of Sodaville, and having given notice as required by law and held a public hearing on November 27, 1990, at 7:30 P.M., at City Hall, 30723 Sodaville Road, Sodaville, Oregon, and no objection being received, and being fully advised,
Hereby determines that it is necessary, expedient and for the best interest of the City to surrender jurisdiction over a certain City road within the City of Sodaville described in Exhibit "A" attached hereto and by this reference incorporated herein.
And hereby RESOLVE that it is the determination of the City of Sodaville City Council to surrender jurisdiction of the above described road to the County of Linn.
It is the intent of this RESOLUTION that if the County of Linn, by appropriate County legislation enacted prior to January 23, 1991, accepts this offer, in whole, the City of Sodaville will surrender full and absolute jurisdiction over the road described in exhibit "A".
EXHIBIT "A"
Beginning at the Northwest comer of Lot 8, Block 3, Hills Addition, to the City of Sodaville, Township 12 South, Range 2 West, Linn County, Oregon; thence East along the North line of Lots 1. and 8, Block 3, Hill Addition to the City of Sodaville; thence East, to the East line of Ash Street as originally Platted which is the west line of Block 9, Town of Sodaville; thence North 6.00 feet along said west line of Block 9 to a point that is North 39.00 feet from the Southwest comer of Lot 3, Block 9, Town of Sodaville; thence East to the west right-of-way line for County Road No. 31 (Sodaville Road), per Deed recorded at Volume 153, Page 154, Linn County Deed Records; thence Northeasterly along the West right-of way ‘line for said County Road No. 31; to a point 49.00 feet North of the South line of Block 4, Town of Sodaville; thence Southwesterly to a point on the north line of Block 9, 30.00 feet West of the West right-of-way line for said County Road No. 31; thence West to a point that is North 66.00 feet from the Northwest comer of Lot 8, Block 3, Hill Addition; thence South 66.00 feet to the point of beginning all in Township 12 South, Range 2 West, Willamette Meridian, City of Sodaville, Linn County, Oregon.
