ORDINANCE 82-4

AN ORDINANCE AMENDING ORDINANCE 81-9 BY REPEALING THE LEGAL DESCRIPTION CONTAINED IN SECTION #2 OF SAID ORDINANCE AND REPLACING IT WITH THE LEGAL DESCRIPTION THAT THE COUNCIL INTENDED AT THE PASSAGE OF ORDINANCE 81-9 AND DECLARING AN EMERGENCY

THE CITY OF SODAVILLE ORDAINS AS FOLLOWS:

Section 1.

The legal description found in Ordinance 81-9 is hereby repealed and by this reference replaced by the legal description found in Section 2 of this Ordinance.

Section 2.

Section 2 of Ordinance 81-9 shall read as follows: The Urban Growth Boundry [sic] of the City of Sodaville is extended to include the following described p roperty [sic] contiguous to the City limits of the City of Sodaville, Linn County, Oregon:

Section 3.

The general welfare of the public will be promoted if this Ordinance takes effect immediately; therefore an emergency is declared and this Ordinance shall take effect immediately upon its passage by the Council and its approval by the Mayor.

EXHIBIT "A"

ANNEXATION BOUNDARY FOR CITY OF SODAVILLE TAX LOT 900

Beginning at the Northwest corner of that certain Tract of land Recorded in microfilm Book 9, Page 389, Linn County Deed Records, said corner being 5.17 chains South of the Northeast corner of Block 21 Summer's Addition to the City of Sodaville, Linn County, Oregon; and running thence South 1°26' West along the City Limits of Sodavile 14.08 chains to a point South 1°26' West 32.50 feet from the Southeast corner of Block 17 of said Addition, said point also being in the Center line of County Road Number 732; thence Southeasterly along said Center line to the East line of the Thomas Summers D.L.C. Number 56; thence North 0°14' West along said East line 62 feet more or less to a 3/4 inch iron pipe; thence continuing North 0°14' West along the East line of said D.L.C. 929.30 feet to the North line of that certain Tract of land Recorded in said Microfilm Book 9, Page 389, Linn County Deed Records; thence West 330.00 feet more or less to the point of beginning.
