CROSS-CONNECTION ORDINANCE

March 2018

An Ordinance establishing the requirements for compliance with the City of Sodaville Water Utility Cross-Connection Program.

This Ordinance shall be known as the City of Sodaville Water Utility Cross-connection Program Ordinance and shall apply to all users of water provided by the City of Sodaville Water Utility.

The City of Sodaville ordains as follows:

ARTICLE 1. INTRODUCTORY PROVISIONS

Section 1.010. Short Title. This ordinance shall be known and may be cited as the City of Sodaville Water Utility Cross-connection Program Ordinance.

Section 1.020. Purpose. Oregon State Law requires that all public water system operators are required to maintain an active cross-connection control program to identify and eliminate or isolate all cross-connections within their systems. This program shall provide for inspections of premises which may contain cross-connections, installation of approved backflow prevention devices, and annual testing of installed devices. Community water systems having 300 or more service connections must make provision for at least one person certified in cross-connection control inspection to carry out the program.

Section 1.030. Scope of Regulations. These regulations are applicable to all City of Sodaville Water Utility water users.

Section 1.040. Definitions. As used in this ordinance, the follow words and phrases shall mean:

Actual Cross-Connections. A connection by pipe, vessel or machine which may contain non-potable water, connected to the potable water connection.

Additional protection. Any devices that are deemed necessary by the City’s Certified Cross-connection Specialist to prevent any actual or potential cross connection contamination.

Approved Backflow Prevention Devices. Backflow devices that have been approved by the State of Oregon.

City of Sodaville City Council. The elected or appointed Mayor and members of the City Council of the City of Sodaville, and actions of the City Council shall be recorded by the City Administrator.

City of Sodaville Water Utility. The City of Sodaville Water Utility, responsible for the provision of potable water to its customers on behalf of the City of Sodaville.

Cross-Connection. A cross-connection is defined as “any actual or potential physical connection between a potable water line and any pipe, vessel or machine containing a non-potable fluid, such that it is possible for the non-potable fluid to enter the potable water system by backflow.”

Cross-connection Specialist. A person who is certified in cross-connection control inspection.

Customer: Any person obtaining water from the City of Sodaville Water Utility.

Drip Systems: An irrigation method that minimizes the use of water and fertilizer by allowing water to drip slowly to the roots of plants, either onto the soil surface or directly onto the root zone, through a network of valves, pipes, tubing, and emitters.

Domestic Water Booster Pumps. Tanks and pumps installed at residences or facilities, to enhance water pressure.

Double check valve (DCVA). Back flow device with two valves or balls that limit flow of water in one direction.

Industrial Equipment. Equipment used in an industrial environment.

Industrial use Dishwashers. Dishwashers use in an industrial environment.

Potential Cross-Connections. A connection that could pose a possible hazard.

Reduced Pressure Principle Backflow Assembly (RP). The RP consists of two internally loaded (weighted or spring loaded) check valves separated by a reduced pressure zone with a relief port to vent water to the atmosphere.

State Certified Backflow Assembly Tester. Person that is certified; as required by the State of Oregon; in the testing of backflow assemblies.

State of Oregon Department of Human Services, Drinking Water Program. The state agency that is responsible for enforcing the laws and rules of the States Drinking Water Program.

Termination of Service. Water service turned off and locked out by the City Of Sodaville Water Utility employee.

Underground Sprinkler Systems: An irrigation method that distributes water in area(s) through a network of valves, pipes, and sprinkler heads buried under the soil.

Water System. City Of Sodaville Water Utility consisting of wells, storage tank, main water lines, lateral lines, valves, pressure reducing stations, pumps and meters.

Well Water Connection. Direct connection to domestic well.

Yearly Testing. Tests preformed on a yearly basis.

Section 1.050. Compliance With Ordinance. Failure to comply with this ordinance shall result in termination of service and may result in additional fees in accordance with City of Sodaville Resolution #15-02, Municipal Fees and Utility Service Rate and Charges.

ARTICLE 2. ACTUAL AND POTENTIONAL CROSS-CONNECTIONS

Section 2.020. Identifying actual or potential cross-connections.

1) Identified cross-connections will be required to supply additional protection. Cross-connections must either be physically disconnected or have approved backflow prevention devices installed.

a) Low Hazard Applications shall have, at a minimum a (DCVA) Double check valve. This shall include but is not limited to domestic water booster pumps, industrial use dishwashers, underground sprinkler systems, and/or drip irrigation systems.

b) High Hazard Applications shall have at a minimum, a (RP) Reduced Pressure Principle Backflow Assembly. This shall include but is not limited to industrial equipment and households with optional well water connection available.

ARTICLE 3. TESTING AND RECORD KEEPING

Section 3.010. Testing Program

  1. Identified cross-connections with added additional protection will be required to undergo yearly testing.

a) Testing is required to be accomplished by a State Certified Tester in the testing of backflow assemblies.

  1. Test results will be mailed or forwarded to the City of Sodaville Water Utility by March 1st of each year.

Section 3.020. Record Keeping

Records must be kept for 10 years. The City of Sodaville Water Utility will keep records on the following:

a) Cross-connections identifying reports

b) Identified cross-connections that have additional protection.

c) Yearly test results

d) Cross-connection Annual Summary Report.

ARTICLE 4. RIGHTS AND RESPONSIBILITIES.

Section 4.000. Purpose of Article 4. This Ordinance is intended to specify the rights and responsibilities for The City of Sodaville Water Utility Cross-Connection Program and the customers of The City of Sodaville Water Utility.

Section 4.010. Responsibilities of City and Water Utility.

Responsibilities of The City of Sodaville Water Utility for implementing and monitoring the City of Sodaville Water Utility Cross-Connection Program.

    1. By State Law it is the City of Sodaville Water Utility’s responsibility to prevent cross-connections from existing within the water system. The City of Sodaville Water Utility shall meet these requirements by conducting ongoing evaluations. The final authority is the responsibility of the City of Sodaville City Council.

Section 4.020. Responsibilities and Rights of The City of Sodaville Water Utility Customers

Responsibilities and Rights of The City of Sodaville Water Utility Customers for complying with the requirements of the City of Sodaville Water Utility Cross-Connection Program.

    1. All customers have the right to safe drinking water. It is the responsibility of all water users to insure that their actions do not affect the safety of the water system. The cross-connection program helps identify actual and potential problems.

    2. It is the responsibility of the Homeowner/Business owner to install and have tested any and all approved backflow prevention devices installed as required by the City’s Public Works Director.

    3. It is the responsibility of the Homeowner/Business owner to forward or have sent to the City of Sodaville Water Utility yearly testing data pertaining to any and all approved backflow prevention devices installed as required by the City’s Certified Cross-connection Specialist, by the first day of March each year.

    4. It is the responsibility of the Homeowner/Business owner to replace and or have repaired as needed, any and all approved backflow prevention devices installed as required by the City of Sodaville. This information shall be forwarded to the City of Sodaville Water Utility.

    5. The Homeowner/Renter/Business owner shall allow access to the City of Sodaville as requested.

Section 4.030. Penalty. A violation of any portion of this ordinance shall be enforced by the immediate termination of service and fee’s applied in accordance with Resolution #15-02 Municipal Fees and Utility Service Rates. Services shall not be restored until violation has been eliminated and fees associated therewith, have been paid.

Section 5.010. Emergency. It is hereby declared that according to State Law, conditions in the City of Sodaville are such that this ordinance is necessary for the immediate preservation of the peace, health, and safety of the City of Sodaville, the Sodaville Water Utility, the Sodaville Water System and the users thereof; and an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage by the council and signed by the Mayor.
