90-02 Vacation

ORDINANCE N0. 90-2

An Ordinance vacating the following described street, towit: As described on Exhibit A, attached hereto and incorporated herein by reference.

FINDINGS:

On the 1st day of May 1990, the City Council of the City of Sodaville passed Ordinance no. 90-2 setting a hearing to be held at 7:30 p.m., Pacific Standard Time on the 6th day of November 1990 at Sodaville, Oregon, at which time and place protests and remonstrances could be heard as to the proposed vacation of the above described street.

Notice was duly and regularly given of the hearing and at said time and place the Council heard all objections.

All persons owning property abutting the street to be vacated have consented to the vacation and applied for the same.

THE CITY OF SODAVILLE DOES ORDAIN AS FOLLOWS:

Section 1.

The City Council of the City of Sodaville finds that due and regular notice of the hearing was posted on October 12th 1990 as required by law, and no valid objections have been made at the hearing or filed. The public interest will not be prejudiced by the vacation of the street.

Section 2.

The hearing was held on the 6th day of November 1990 at 7:30 p.m., Pacific Standard Time, at Sodaville, Oregon, and all matters necessary to be done in the premises have been duly and regularly completed.

Section 3.

The hereinabove described street is hereby vacated, and the street so vacated shall revert pursuant to the statutes of the State of Oregon.

Section 4.

Ordinances 8, 17, 22 and 84-2 are hereby repealed.

Section 5.

The City Recorder is hereby directed to file a certified copy of this Ordinance with the Recorder of Linn County, Oregon, together with a map or plat of said property, and a certified copy of this Ordinance shall be filed with the Linn County Assessor and another certified copy shall be filed with the Linn County Surveyor.

EXHIBIT A

Vacation Description for Ordinance

Rock Street between the West line of Fisher Street and the East line of Park Street, lying between Block 1 and Block 2 of Hill's Addition to the Town of Sodaville as recorded in Book 3, page 20, Book of Plats, Linn county, Oregon.
