96-02 Water Utility

ORDINANCE NO 96-2

AN ORDINANCE AMENDING ORDINANCE NO 82-8, “RATES, RULES and REGULATIONS FOR THE OPERATION OF THE WATER UTILITY OF THE CITY OF SODAVILLE;

To amend Ordinance 82-8 THE CITY OF SODAVILLE ORDAINS AS FOLLOWS:

Section 6

(5) A new account fee set by resolution will be collected for each new account application, permitting the turn on during regular working hours. A new account is defined as the “initial process of application for service, setting up a billing procedure, reading of the meter, and turning on the water or any part thereof and at a single location for a given customer.”

The water rates to be charged for each class of service, including minimum charges, charges, for water used over the minimum and water system development fees which include the costs of installing a new service, including excavation and backfill; tapping the main; laying the pipe; installing the meter, yoke and meter box; and replacement of surfacing materials shall be established by resolution.

(7) 4. A substantial deposit may be required in addition to payment of the delinquent account before water service will be resumed. This action to be taken is within the discretion of the City Council. A rebilling charge set by resolution will be added to the amount past due to cover the cost of processing this notice. The notice will also state that the water utility service charge will be set by resolution.

(c) Turn Off Notice: 0n the thirtieth day after the account becomes delinquent, a turn-off notice will be hand delivered to the service address stating that the water will be turned off if payment if full is not received within five days. A delivery of turn-off notice charge set by resolution will be added to the amount past due to cover the cost of delivering this notice.

(d) Service turn-off: 0n the turn-off date, the Public Works Superintendent or other agent of the City of Sodaville shall deliver a written notice to the customer stating that the water service is being turned off until all delinquent amounts have been paid. The Public Works Superintendent or other agent of the City shall immediately thereafter turn off the service. A delivery to the premises served by the meter shall be considered a delivery to the customer. A turn-off charge will be set by resolution will be added to the amount past due.

Section 13

(b) On customer request: A customer may, give no less then seven days notice, request the Water Utility to test the meter servicing his premises. The Water Utility will require the customer to deposit the testing fee. This fee shall be an amount set by resolution for meters 3/4 inch and smaller, and for meters larger then 3/4 inch shall be an estimate of the cost of testing the meter as determined by the Public Works Superintendent. The deposit will be returned to the customer if the test reveals the meter to over register more than 2 percent under the standard test conditions, the deposit shall be retained by the Water Utility. Customers may at their option witness any meter tests which they request.

Section 15

(1) Restoration of service after discontinuance for nonpayment of bills shall be made after payment of current and past due charges on an amount set by resolution for restoration charge and posting a deposit as hereinto provided.

(2) Restoration of service after discontinuance of service for unsafe facilities, water waste, fraud, abuse or for noncompliance with any of the policies, rules or regulations will only be made after the irregularity has besn corrected and the Water Utility has been assured that the irregularity will not reoccur. The restoration charge shall be an amount set by resolution plus any other charges due or past due that the Water Utility may have incurred to correct the irregularity.

Section 28 Emergency Clause

The City Council hereby determines that existing conditions are such that this ordinance is immediately necessary for the protection of the present health, safety and good of the City of Sodaville and the property owners and citizens thereof and, therefore, an emergency in here by declared to exist and this ordinance shall be in full force and effect immediately after its passage by the Council and approval by the Mayor.
