Professional Personnel Transfer
On or before the first Money in May, the Superintendent shall submit a list of those teachers to be considered for transfer and subsequent assignment to each Board member. According to West Virginia School Law 18-5-4, it is not necessary for the Superintendent to supply a list of teachers or coaches who are to be reassigned to the schools where they served in the preceding year.
Teachers placed on a list for transfer and subsequent assignment must be entered into the minute record.
Those teachers recommended for transfer and subsequent assignment must be notified in writing, by certified mail, return receipt requested to such teachers’ last known addresses within ten days following the Board meeting at which their transfer and subsequent assignment were requested. The list for transfer and subsequent assignment cannot be acted upon at the meeting at which recommendation for transfer and subsequent assignment is submitted. Adequate time must be given between the meeting at which the recommendation was made and the final placement of the teacher to permit him/her to have a hearing before the Board.
The teacher recommended for transfer has a right to a hearing before the Board concerning the causes for transfer and a reasonable time should be set for the teacher to appear. The notice should state the time and place for a hearing on the proposed transfer.
