Objective:
1. Students should understand the relationship between our maritime law and relevant international conventions, practices, or foreign laws, as well as trends in the development of international maritime law.
2. Students should be able to accurately state the relevant provisions, foundational theories, and practical or doctrinal disputes of our current maritime law.
3. When faced with relevant factual statements, students should be able to identify the legal disputes arising from those facts, articulate the applicable regulations and principles, and explain how these can be applied to resolve the legal disputes.
Course Prerequisites: This course serves as an introductory overview for the series of maritime law courses.
Outline: This course is divided into four subfields:
1. Introduction to Maritime Law
- Week 1: Course Introduction: National Ocean Policy, International Trade, and Maritime Law
- Week 2: Scope of Application of Maritime Law
2. Maritime Transportation Law
- Weeks 3-6: Bill of Lading and Cargo Transportation
- Week 7: Charter Transportation
- Week 8: Passenger Transportation; Container Transportation and Multimodal Transport
3. Maritime Law
- Week 9: Midterm Review Week
- Week 10: Ship Ownership, Ship Mortgages, and Maritime Liens
- Week 11: Ship Collisions
- Week 12: Towing and Salvage
- Week 13: Limitation of Shipowner Liability; Enforcement of Ship Claims
4. Maritime Insurance Law and General Average Law
- Week 14: Insurable Interest and Principles of Loss Compensation
- Week 15: Maritime Insurance: Valued Insurance, Average, Partial and Total Loss; General Average Law
- Weeks 16-18: Final Reports
