Form Addition
07002-IL-Buyers Order - Affects IL locations
For Illinois, per McGlinchey’s audit, a new form identified as F2200_A_IL has been added to Discover to supplement the Illinois Buyer’s Order for properly disclosing the optional ERT fee. This fee must be distinguished from other language with the use of bold, colored, italic, or underscored type or by using a larger font or the fee shall be identified on a separate document with a signature line indicating the Buyer's acceptance or rejection of the option of paying the fee. Discover is unable to accomplish the change to this fee item in the Buyer’s Order form, so McGlinchey provided this separate document F2200_A_IL for meeting the requirement. Two versions of this form have been programmed for SecureClose for handling the Buyer(s) choice of agreeing or declining this fee: 07003-IL-Buyer's Ord Optional ERT Fee - Agree and 07003-IL-Buyer's Ord Optional Fee - Decline.
For Illinois, per McGlinchey’s audit, changes were made to the F2200_IL Buyer’s Order. Those changes included:
- a third page was added for the "No public liability insurance issued with this transaction" statement
- The sub fee type of "Extended Service" will be updated to "Optional Service Contract"
Additional Information Provided on 5/26/2022:
For all IL locations, two new forms were added to the "Select All SC Docs" button:
- 07003-IL-Buyers Ord Optional ERT Fee - Agree
- 07003-IL-Buyers Ord Optional ERT Fee - Decline
This form supplements the Buyer's Order for compliance with Illinois state law. If the buyer Agrees to the ERT Fee, the "07003-IL-Buyers Ord Optional ERT Fee - Decline" document needs to be unchecked so that the document does not get signed by the customer and sent to Secure Close. If the buyer Declines the ERT Fee, the "07003-IL-Buyers Ord Optional ERT Fee - Agree" document needs to be unchecked so that the document does not get signed by the customer and sent to Secure Close.
