On 21 Jun 1794 David Secord wrote to Thomas Dickson, Esq. concerning his Lots 42 and 43 in the Township of Newark noting Samuel Street laid claim and was entered for them. He requested this be represented to His Excellency and acquainted him with the circumstances. His father James Secord with the sanction of Col. Mason Bolton (then Commandant) in the year 1780 settled on Lots No. 42, 54, 44 and 50 on which lands he made considerable improvements, and in the year 1784 he deceased leaving his lands by will to his youngest brother James Secord and himself [David Secord]. He immediately took charge of said farm and after Mr. Frey had surveyed David Secord wanted to have his name inserted for the same as also for Lots No. 45 and 47 then vacant which was then allowed and a ticket granted him. Secord since made large improvements on every lot in all upwards 160 acres cleared and under cultivation and from the year 1784 until 1790 or 1791 he never understood that any person laid the least claim to any part of his lands. It was then represented to Secord that Mr. Street claimed Lots No. 44 and 45. Secord went immediately to him to know whether he claimed these two lots and he answered he did. Secord asked him by what right and he said by having Mr. Frey’s ticket. Secord told him he had Mr. Frey’s ticket also for these lots, that the first land his father improved was on Lot No 44 (the road only parting that from the front of the houses) and on Lot No. 45 I had a large clearing before Mr. Frey ever surveyed any lands in this settlement.
