On 3 May 1791 the Land Board read the petition of Richard Van Husen for a grant of 200 acres of land in the Township No. Fort Erie (Bertie) and found him qualified to receive a lot and is entitled to a further assignment of 200 acres for his wife and three children. The order was referred to Acting Surveyor General Augustus Jones who assigned to him 200 acres in Lot 3 Concession 5 and Lot 9 Concession 12 from the Niagara River of Township No. (Bertie Township Papers 0497)

Warren, Henry

On 30 May 1796 Henry Warren certified that his name came on Lot 15 Concession 3 without his knowledge. He laid no claim to said lot and was willing it should be given to this person. Signed Henry Warren. (Bertie Township Papers 0413)

John Warren signed an undated statement of the lands granted to him on 3 May 1791 by Land Board Certificate with the assignment of Surveyor General A. Jones on the same date—14 Lots of 100 acres each No. 4 in 1st Concession; No 4 in 2nd Concession; No. 4 in 3rd Concession; No. 5 in 4th Concession; No. 9, 10, 11, 12, 13 in 11th Concession; No. 10, 11, 12, 13, 14 in the 12th Concession. On 18 Apr 1795 John Warren renounced all his right and title and quit claimed 50 acres of land adjoining Lot 3 Concession 2 Bertie Twp. of which he stood possessed and certified that by an agreement made between Benjamin Wintermute and Joseph Petrie, the latter having obtained a certificate from the Land Board for 100 acres of said lot which he has surveyed to said Benjamin. That the above mentioned fifty acres does in consequence of their agreement vest in and become the real property of Benjamin Wintermute. Signed John Warren (Bertie Township Papers 0290)

On 6 Aug 1796 Acting Surveyor General D. W. Smith prepared a surveyor’s assignment for John Warren for 1440 acres of land in No. 4 in 1st Concession; No 4 in 2nd Concession; No. 4 in 3rd Concession; No. 5 in 4th Concession; No. 9, 10, 11, 12, 13 in 11th Concession; No. 10, 11, 12, 13, 14 in the 12th Concession. On 28 Jun 1796 John Warren Sr. appointed Samuel Street his attorney to ask for and receive from William Jarvis Esq., his Majesty’s Secretary of this Province, the necessary deed or deeds of grant of one hundred acres of land being part of Lot No. 3 Concession 1 on the River below the rapid near Fort Erie in the Township of Bertie, and to transfer the deed to Benjamin Hardison of said township. On 1 Aug 1801 John Warren wrote to Deputy Surveyor General D. W. Smith that his son Edmund will thankfully take the lot in Beverly. (Bertie Township Papers 0292)

On 19 Jan 1802 John Warren wrote to the Executive Council after reading in the York Gazette that a patent is ready to be delivered for 120 acres of land to Constantine O’Neil of Bertie which he hoped was a mistake as Warren sometime ago purchase his place which was understood to contain 220 acres, being Lots number 5 in the first and second concessions on Lake Erie (Bertie Township Papers 0164)

On 3 Aug 1811 the Lieutenant Governor’s Office ordered to John Warren Esq. Lots 1 and 2 Concession 14, Lots 6, 7, 8 Concession 11, Lot 1 Concession 15, Lot 1 Concession 16 in the Broken Front, Lot 28 Concession 1 and Lot 29 Concession 1 Bertie Twp. (Bertie Township Papers 0048)

On 1 Mar 1817 John Warren wrote to Surveyor General Thomas Ridout to enclose a description of Lot 1 Concession 16 Bertie as lately surveyed by Mr. Shubael Park. He sold this land sometime since to James Kennedy who resides on it and it appears from this survey that the lot only contains 63 acres and he had 100 as expressed in the Kings Patent. Kennedy states that there is a strip of vacant land immediately in rear of his on the west side of the lot between Bertie and Humberstone and has requested Warren to enquire if he can obtain a part of it to make up the deficiency in his lot. Warren, John Jr.

On 16 Apr 1811 William Halton wrote to Surveyor General Thomas Ridout Esquire stating the Lieutenant Governor commanded him to desire Ridout to transmit to Halton`s office descriptions of Lots 6 and 7 Concessions 5 and 6 Bertie Twp. for the purpose of issuing a license of occupation to J. On 10 Dec 1811 the Executive Council of Upper Canada gave a grant to John Warren the Younger of Bertie Twp., Esquire for 700 acres of land in Lots 6, 7 and 8 Concession 11 and Lots 1 and 2 Concession 14 and Lot 1 Concession 15 and Lot 1 Concession 16 from the Niagara River Bertie Twp. as per Order in Council dated 7 Aug 1811 (Bertie Township Papers 0722)

On 10 Dec 1811 the Executive Council of Upper Canada gave a grant to John Warren the Younger of Bertie Twp., Esquire for 700 acres of land in Lot 29 Front Concession upon Lake Erie Bertie Twp. as per Order in Council dated 7 Aug 1811 (Bertie Township Papers 0723)

Williams, Frederick

Wilson, Benjamin

On 3 May 1791 the Land Board read the petition of “Croel” Wilson noting he had received 200 acres land in the Township No. Fort Erie (Bertie) as a Loyalist and settled and improved upon it found him qualified to a further assignment of 100 acres for his wife and one child. A note in the margin “a Wife & Child Settled in 1787. Windecker, Henry

Winger, Henry

On 26 Jun 1848 James Cummings wrote to J. H. Price, Commissioner of Crown Lands that sometime in 1846 or 1847 Henry Winger of Bertie Twp. sent a memorial to the Governor General stating he purchased Lots 10 and 11 Concession 16 Bertie Twp. said to contain 100 each but on actual survey they only contain about 60 acres each. He asked that the deficiency might be made up to him. He was encouraged so to do by his neighbour James Kennedy being similarly situated. “This man is an honest old Dutchman, and thinks it unfair and unjust to withhold his claim when others have received compensation.” (Bertie Township Papers 0002)

Butler’s Rangers, and that he is settled on and improved the same, and that he is entitled to a further assignment of two hundred acres for his family. In an undated memo apparently the order of the Niagara Claims Commission, it was noted Peter Wintermute in his life time of the Township of Bertie was nominee of the Crown of the lands herein after granted and departed this life without obtaining a Patent for the same having first duly made and published his last will and testament in writing bearing date the 17th day of May 1837 whereby after making various devises and bequests, he ordered and directed in words following, that is to say “Tenth- It is my will and Order that the residue of all my lands be sold by public auction to the highest bidder for Cash only also one half of my Stock of Cattle to be sold three months after my decease and the proceeds of the sale of my lands and Stock of Cattle &c after all my lawful debts are paid to be equally divided between my sons William John and Alexander and my daughters Hannah Mary and Sarah, their heirs, executors or administrators- the land and other property which I will to be sold to be sold by my Executor whom I do hereby authorize to make or cause to be made in fee simple good and lawful deed or deeds for such lands as by him sold and that my executor divide between my children after all my just debts are paid the proceeds remaining of the Sale of Lands Cattle &c.

“Eleventh and I do hereby constitute and appoint William Powell Esquire of the Township of Bertie, District and Province aforesaid my sole executor of this my last will and testament.

And whereas after the death of the said Peter Wintermute the testator, William Powell, Executor claimed the land herinafter granted under and subject to the provisions of the will before the Commissioners appointed to ascertain titles to lands in cases where no patent has issued, upon the hearing of which claim in the month of July past the Commissioners did report in favour of the same.

“Now know ye that We taking the premises into our royal consideration have given &c. To have and to hold unto the said William Powell his Heirs and assigns for ever under and subject to the several trusts, powers, provisions, declarations, limitations, estates and conditions in the said in part recited will of the said Peter Wintermute Senior deceased expressed and contained of and concerning the same. On 16 Jan 1841 The Surveyor General prepared a surveyor’s assignment for William Powell, Executor under the will of Peter Wintermute, deceased for 200 acres of land in Lot 26 Concession 4 Humberstone Twp. as per the Claims Commissioners Report of 2 Jul 1840 (Bertie Township Papers 0489)

Wintermute, Philip

On 16 Sep 1797 John Powell wrote to D. W. Smith Esq. that it was agreed at the Land Board that Lots 8 and 9 in Concession 1 Fort Erie Township (sic: Bertie) should be divided in three equal parts between Philip Wintermute, Henry Angerish and himself—settled before the Land Board the 4th of November 1791 (Bertie Township Papers 0171)

Extract from the Attorney General issued by the Surveyor General’s Office on 11 Apr 1806 noting Land Board Certificate 3 May 1791 and Mr. Jones Deputy Surveyor`s assignment for Lots 8 and 9 Concession 1 Bertie Twp. with the partition by order of the Land Board as follows, vizt. “These two Lots are to be equally divided between Philip Wintermute, John Powell Eq and Henry Anguish who are to have one third each.” (Bertie Township Papers 0175)

On 11 Apr 1806 William Jarvis, Secretary wrote to the Surveyor General noting there has not been a deed completed in the name of Philip Wintermute for the north part of Lot No. 8 and the south part of No. 9 on the River Niagara in Bertie (Bertie Township Papers 0474)

Wright, William

On 30 Mar 1795 William Wright aged 33, born in Ireland, farmer appeared before John Small and took the prescribed oaths and was recommended for a grant of 200 acres of land. On 14 Apr 1795 Acting Surveyor General D. W. Smith assigned to him 200 acres in Lot 15 Concessions 7 and 8 from the Niagara River Bertie Twp. (Bertie Township Papers 0631)

On 22 Aug 1795 William Wright assigned all his right and interest in Lot 15 Concessions 7 and 8 from the Niagara River Bertie Twp. to Alexander Summers. William Wright made his mark. Witnessed by John McKinniray and John Donaldson. (Bertie Township Papers 0630)

Young, Adam

On 25 Sep 1786, the surveyor certified there is surveyed for John Garner a lot in the second concession Fort Erie Township known by the name of Lot No. containing one hundred acres. At the bottom of this John Garner Junr. wrote “I Do Give up my Right and Title to this Lot of Land to Adam Young. (Bertie Township Papers 0285)

On 7 Jul 1797 John Garner Jr. certified he sold to Mr. Adam Young a lot of land in the second concession bounded by the Garrison Line containing one hundred acres of land with all his right and title and the small improvements made. Lot is known by No. in the second concession. Signed by John Garner Junr. And witnessed by Henry Putman and Henrich Windecker (Bertie Township Papers 0285)

Young, Daniel

Daniel Young has purchased Lot 1 Concession 2 Bertie Twp. at Fort Erie from John Garner Jr. and Wilson understood some other people wished to lay claim to the lot as if they had been the purchasers. Wilson wrote to Daniel Young to produce his claim at the Surveyor’s Office and asked that he be obliged and that the Acting Surveyor General not give a grant to any other persons for the land. Young applied to the Land Board for a certificate in the previous July and would have obtained it but there was no other member present at that time but Mr. Hamilton. (Bertie Township Papers 280)
