Garner, John Jr.

On 25 Sep 1786, the surveyor certified he surveyed for John Garner a lot in the second concession Fort Erie Township known by the name of Lot No. containing one hundred acres. At the bottom of this John Garner Junr. wrote “I Do Give up my Right and Title to this Lot of Land to Adam Young. (Bertie Township Papers 0285)

On 27 May 1790 John Garner wrote to Acting Surveyor General D. W. Smith saying he was informed that some person has applied for the lot of land he lived on Lot 6 Concession 12 in the rear of the lot purchased by Doctor Raymond of Mr. Mabee up the one side of John Capas and on the other side by Col. Powell. Garner noted Lot 3 Concessions 7 and 8 one of which was by mistake entered on the map for his son George who gave him a certificate. The lot he lived on he had greatly improved with a house, barn and stabling and he was on it upwards of five years, one of the first settlers in the Township of Bertie and he had been in this country upwards of seventeen years, was taken prisoner by the Americans and lost a large property when taken. On 17 May 1792 John Furria received from John Garner a note of hand for ten pounds NY Currency payable for a lot of land containing one hundred acres more or less situated on Dep[r]ans Creek the rear of George Wintermutes. John Furria made his mark, witnessed by Parshall Terry (Bertie Township Papers 0624)

On 17 May 1792 John Furya certified that he sold to John Garner his improveent and claim to Lot 14 Concession 7 of Fort Erie Township for ten pounds NY Currency. John Forya made his mark, witnessed by Parshall Terry. (Bertie Township Papers 0626)

On 17 May 1792 John Garner signed a promissory note that he would pay to John Furia ten pounds NY Currency for his improvement on Depras Creek. Witnessed by John Troyer and Parshall Terry. John Furia certified he received on the within note six bushels of wheat £2.00, Mr. Garner paid to Mr. Docstader for him £2.14.0, he had one calf £0.10.0, Mr. Garner had [J]of [J]other of me to the amount of four shillings to be taken out of the calf skin which leaves five pound of said not due to Furya from Mr. Garner. On 17 Jun 1795 John Wilson wrote to Acting Surveyor general D. W. Smith stating Daniel Young has purchased Lot 1 Concession 2 Bertie Twp. at Fort Erie from John Garner Jr. and Wilson understood some other people wished to lay claim to the lot as if they had been the purchasers. Wilson wrote to Daniel Young to produce his claim at the Surveyor’s Office and asked that he be obliged and that the Acting Surveyor General not give a grant to any other persons for the land. Young applied to the Land Board for a certificate in the previous July and would have obtained it but there was no other member present at that time but Mr. Hamilton. (Bertie Township Papers 0280)

On 28 Aug 1795 Acting Surveyor General D. W. Smith gave a surveyor’s description to John Garner for 136 acres of land in Lot 1 Front Concession on the Niagara River Bertie Twp. not including the mill site occupied by William Dunbar (Bertie Township Papers 0450)

On 11 Nov 1796 the Land Board granted a ticket to John Garner Lot 1 Concession 2, Lot 3 Concession 7, Lot 3 Concession 8 and Lot 12 Concession 5 (Bertie Township Papers 0282).

On 7 Jul 1797 John Garner Jr. certified he sold to Mr. Adam Young a lot of land in the second concession bounded by the Garrison Line containing one hundred acres of land with all his right and title and the small improvements made. Graham, Richard

On 26 Jul 1831 Richard Graham wrote to Hon. Peter Robinson stating by enquiring at the Surveyor General office, he found that Lot 8 Concession 10 Bertie Twp. has been granted at the early settlement of the township to a person by the name of Johnson but the deed was never issued from the Crown office. Graham wished to purchase the land provided the value set upon it is not great. He was a resident of the township and he knows of no person by that name and supposed it may belong still to the Crown. On 14 Nov 1831 Richard Graham wrote a second letter to Hon. Peter Robinson concerning Lot 8 Concession 10 Bertie Twp. containing 100 acres. He understood it was granted to a person by the name of John Johnson at the early settlement of the township but who never settled it nor was now within the limits of the township. He also understood he had not obtained the Crown patent for the lot and if the grantee does not make good his claim it reverts to the Crown and can be sold. If this is the case Graham would be glad to purchase it provided the price set upon it is not greater than its value. Signed Richard Graham. (Bertie Township Papers 0710)

On 14 May 1833 Richard Graham wrote a third letter to Hon. Peter Robinson concerning Lot 8 Concession 10 Bertie Twp. He applied for the purpose of claiming before the Commissioner under the Heir and Devizees Act. The heirs of the original nominee of the crown John Johnson now deceased. He intended to claim it at the next sitting of the Commissioners. He advertised on 8 January 1833 stating that unless the said John Johnson or his heirs make good their claim to said lot within three months it would be otherwise disposed of. He understood it had been applied for by Mr. Joseph Demer of Willoughby Twp. Graham requested the lot be sold to himself and asked to be informed of the best possible means by which he could secure to the hairs the said lot at the lowest possible rate. Signed Richard Graham. Gregory, John

On 13 Apr 1792 the Land Board read the petition of John Gregory for a grant of 200 acres of land in the Township of Fort Erie (Bertie) behind the marsh and found him qualified to receive a lot. Note of the Land Board on the reverse: “The Bearer, John Gregory having petitioned this Board for leave to dispose of the within named Lots No. 15 & 16 in the 2nd Concession of Fort Erie Township to Daniel Forsyth the Board therefore direct the aforesaid lots to be Transferred to the said Daniel Forsyth. Gustin, John

On 13 Sep 1803 Acting Surveyors General Chewett and Ridout prepared a surveyor’s assignment for Aaron Skinner of Bertie Twp., yeoman for 150 acres of land in Lot 2 and broken fronts on Lake Erie in Bertie Twp. At the bottom is noted John Gustin original nominee (Bertie Township Papers 0121)

Hamilton, Robert

On 29 Mar 1790 the Land Board read the petition of Robert Hamilton for a grant of 200 acres of land in the Township No. 1 (Bertie) and found him qualified to receive a lot. The order was referred to Acting Surveyor Augustus who on 22 Nov 1790 assigned to him 200 acres in Lot 6 Concession not stated from the Niagara River of Township No. 1 (Bertie Township Papers 0820)

On 10 Jun 1794 the Executive Council of Upper Canada gave a grant to Hon. Robert Hamilton for 3000 acres of land. On 11 Feb 1795 Acting Surveyor General D. W. Smith prepared a surveyor’s certificate for The Honorable Robert Hamilton for 1000 acres of land in Lots 2, 3, 4, 5 and 6 Concession 15 and Lots 2, 3, 4, 5 and 6 Concession 16 from the Niagara River Bertie Twp. He was further granted 2000 acres in Lots 225, 226, 227, 228, 231, 232, 233, 234, 235, 236, 237, 240, 242, 243, 244, 245, 246, 253, 254 and 258 Thorold Twp. (Bertie Township Papers 0816, 0817, 0818)

On 23 Sep 1796 Acting Surveyor General D. W. Smith prepared an undated surveyor’s assignment for The Honorable Robert Hamilton for 1000 acres of land in Lots 2, 3, 4, 5 and 6 Concessions 15 and 16 from the Niagara River Bertie Twp. and Lots 225, 226, 227, 228, 231, 232, 233, 234, 235, 236, 237, 240, 242, 243, 244, 245, 246, 253, 254 and 258 Thorold Twp. Hardison, Benjamin

On 1 Aug 1795 John Warren J. P. certified that Lot 16, formerly the last lot in the sixth concession of the Township of Bertie never did belong nor ever was claimed by Catherine Dunn, but always has been understood to be the property of Mr. Benjamin Hardison. (Bertie Township Papers 0597)

On 4 Mar 1820 Surveyor General Thomas Ridout gave a surveyor’s description to Benjamin Hardison of Bertie Twp., gentleman for 100 acres of land in the east part of Lot 3 Concession 1 from the Niagara River Bertie Twp. as per 12th Claim Commissioners Report of Jul 1819. Harrett, John

On 26 Feb 1797 the Executive Council of Upper Canada gave a grant to John Harrett for Lots 28 and 29 Fort Erie (Bertie) Twp. and 100 acres in family lands (Bertie Township Papers 0352)

On 20 Mar 1797 Acting Surveyor General D. W. Smith prepared a surveyor’s assignment for John Harrett for 200 acres of land in Lots 28 and 29 Concession 2 from Lake Erie Bertie Twp. (Bertie Township Papers 0354)

Hause/House, John

On 3 May 1791 the Land Board read the petition of John Hause for a grant of 200 acres of land in the Township No. Fort Erie (Bertie) and found him qualified to receive a lot. The order was referred to Acting Surveyor General Augustus Jones who assigned to him 200 acres in Lots 9 and 10 Concession 7 from the Niagara River of Township No. Fort Erie (Bertie Township Papers 0617)

On 3 May 1791 the Land Board read the petition of John Hause for a grant of 200 acres of land in the Township No. Fort Erie (Bertie) and found him qualified to receive a lot. The order was referred to Acting Surveyor General Augustus Jones who assigned to him 200 acres in Lots 11 and 12 Concession 7 from the Niagara River of Township No. Fort Erie (Bertie Township Papers 0002)

Hawn, Jacob

On 30 Oct 1796 Jacob Haun certified that he had no claim, right, or title to Lot 19 Concession 2 Bertie, and that he never received any certificate for that Lot, the entry of which in my name must be a mistake. Hawn/Haun, Matthias Sr.

On 3 May 1791 the Land Board read the petition of Matthias Horn (sic) Sr. for a grant of 200 acres of land in the Township No 2 and 3 and found him qualified to receive a lot. The order was referred to Acting Surveyor General Augustus Jones who assigned to Horn 200 acres in Lot 20 Concession 1 of Township No. (Bertie) and No. 8 Concession 1 Township No. 3 (Grantham) (Bertie Township Papers 0230)

Acting Surveyor General D. W. Smith prepared an undated surveyor’s assignment for Mathias Horn (sic) Senr for 200 acres of land in Lots 20 and 32 Concession 1 Bertie Twp. containing 120 and 100 acres respectively. Added note Lot No 32 is the 9th Lot of the southwestern most addition to Bertie (Bertie Township Papers 0233)

In a note of the Land Board dated at Newark on 15 Feb 1794, the Board consented to the transfer of Lot 22 in Front of the First Concession Bertie Twp. from Edward Pier to Matthias Hawn (Bertie Township Papers 0031)

On 2 May 1797 Acting Surveyor General D. W. Smith prepared a surveyor’s assignment for Matthias Hawn (transferred from Edward Pier) for 72 acres of land in Lot 22 in front of the First Concession Bertie Twp. (Bertie Township Papers 0033)

On 12 Sep 1803 the Executive Council of Upper Canada gave a grant to Matthias Hawn of Bertie Twp., farmer for 200 acres of land in Lot 24 Broken Front on Lake Erie in Bertie Twp. (Bertie Township Papers 0035)

On 10 Mar 1830 a letter noting Matthias Hawn in his lifetime had Lot 9 in front on Lake Erie Township of Bertie and sold to Archibald Cole for $900 and took a mortgage. This property had been abandoned by Cole 7 years then nothing has been since heard. Matthias Hawn resumed the property immediately on Cole’s departure and after the death of Matthias, John his son tenanted the property until his departure from the County to Walpole. Since this Isaac [L] Hawn has come in possession by direction of Mahlon Burwell one of the Executors of Matthias Hawn, resided there a year. (Bertie Township Papers 0183)

Hawn, Matthias Jr.

On 3 May 1791 the Land Board read the petition of Matthias Horn (sic) Junr. for a grant of 200 acres of land in the Township No 2 (Bertie) and found him qualified to receive a lot. The order was referred to Acting Surveyor General Augustus Jones who assigned to Horn 1000 acres in Lot 23 Concession 1 of Township No. and broken front (Bertie Township Papers 0245)

On 2 May 1797 Acting Surveyor General D. W. Smith prepared an undated surveyor’s assignment for Matthias Horn (sic) Jr. for 200 acres of land in Lot 23 Concession 1 Bertie Twp. (Bertie Township Papers 0246)

Hawn, Wilson

On 24 Dec 1830 J. S. Hawn wrote to Wilson Hawn stating the Augustin Farm in Lot 9 in front on Lake Erie Bertie Twp. 100 acres was under some difficulty. It was thought requisite that Wilson as the oldest son of their late father should give a quitclaim for it. The estate was indebted to Samuel Street Esquire to whom they wished to give this lot in security. If he was to make a quitclaim to him it would be satisfactory to all. Signed J. S. On 18 Mar 1831 Samuel Street of Stamford Twp. and Willson Hawn of Bertie Twp. signed articles of agreement concerning a bond executed by Willson Hawn for the payment of eighty-five pounds with legal interest. Hawn was to pay forty-two pounds ten shillings on or before 1 Mar 1832 and a further sum of forty-two pounds ten shillings on or before 1 Mar 1833. Street would then issue a deed for the land in Bertie Twp. where John Oliver then resided containing sixty-six acres formerly belonging to Henry Warren Esquire. On 9 Jul 1803 the Executive Council of Upper Canada gave a grant to Abraham Hershey of Bertie Twp., farmer for Lot 7 First Cross Concession Bertie Twp. on the Niagara River opposite the south end of Grand Island (Bertie Township Papers 0022)

Hoffman, Jacob

Acting Surveyor General D. W. Smith prepared an undated surveyor’s assignment for Jacob Hoffman (served in Jessups Corps) for 300 acres of land in Lot 3 Concessions 9, 10 and 11 from the Niagara River Bertie Twp. Signed Jacob Hoffman. (Bertie Township Papers 0676)

Acting Surveyor General D. W. Smith prepared an undated surveyor’s assignment for Frederick Anger Sen. for 50 acres of land in the north half of Lot 8 Concession 8 from the Niagara River Bertie Twp. Added note: N Hoffmans name was on this lot—the other half of it has been described for Peggy Hoffman (Bertie Township Papers 0657)

Hoffman, Nicholas Sr.

On 3 May 1791 the Land Board read the petition of John Carl for a grant of 200 acres of land in the Township No. Fort Erie (Bertie) and found him qualified to receive a lot. On 22 Oct 1796 Acting Surveyor General D. W. Smith prepared an undated surveyor’s assignment for Nicholas Hoffman for 200 acres of land in Lot 4 Concessions 10 and 11 from the Niagara River Bertie Twp. (Bertie Township Papers 0702)

Huffman, Michael

On 29 Jun 1795 Michael Huffman aged 34, born in the State of “Vergeny”, husbandman appeared before Parshall Terry J. P. and took the prescribed oaths and was recommended for a grant of 200 acres of land. Note of 18 May 1811 written by Surveyor General Thomas Ridout: Warrant No. 135 dated 26 May 1796 issued from the Executive Council office for Lot 21 Concession 3 from Lake Erie and Lot 5 Concession 11 from the Niagara River Bertie Twp. A description No. 1839 prepared in 1796. But Mr. Jarvis having this day certified that no deed was completed to Michael Huffman. Another description will be prepared as soon as the Attorney General Fiat is received at the Surveyor General’s Office. The patent fee has been paid to the Receiver General. On 8 Jun 1796 Charles Anger certified that he quit all claim to Lot 21 Concession 3 Bertie Twp. and returned it as being vacant land to be possessed by Michael Huffman he laying his right thereon. Signed by Charles Anger and witnessed by John Garner (Bertie Township Papers 0424)

On 8 Jun 1796 Michael Hofman wrote to Acting Surveyor General D. W. Smith stating he had a warrant for two hundred acres of land from Mr. Small and asking to be entered on Lot 21 for which he sent a certificate that Charles Anger quit claim. He also requested Lot 5 Concession 11 if vacant or Lot 4 Concession 9 Bertie Twp. He noted he would rather have Lot 28 Concession 5. Signed Michael Hofman. (Bertie Township Papers 0678)
