On 2 Apr 1801 Archibald Cunningham wrote to Acting Surveyor General D. W. Smith stating he never drew any land in Newark or any part of the province (the 1200 in Burford excepted. The lots he owns in Niagara 11 and 36 were originally granted to Joseph Robinson, sold by him to John Chrysler and Joseph Brown and by them to me. Robinson had a separate Land Board Certificate for each lot and Cunningham had them transferred in his own name. One of the originals for 36 was given in to Mr. White February 1793 and by some mistake afterwards both came to Smith’s office and the description for 36 was put in the name of Chrysler and Brown. Smith advised Cunningham it could not be otherwise, their Certificate being prior in date to his and that to have it allowed he must petition the Council. Cunningham did so and the Solicitor General succeeded in the application. No. 39 he purchased from Peter Clow and had transferred by the Land Board Certificate. Smith advised him as far back ass 22 Nov 1797 the description had passed Smith’s office. The Solicitor General informed him after repeated searching no trace of it could be found. The patent for No. 11 has come out in his name, but it was actually a purchase. Mr. Hamilton was the gentleman who paid the price of the four lots on his account. Signed by Archibald Cunningham. He had sold the same and by bona fide transfer it came into the hands of A. Rogers for £50 and that thereupon during a possession of many years he had erected two houses of the value of £500 at least.
