Alward, Daniel Jr.

On 3 May 1791 the Land Board read the petition of Richard Ruth for a grant of 200 acres of land in Township No. 3 (Fort Erie crossed out-sic: Bertie) and found him qualified to receive a lot. The order was referred to Acting Surveyor General Augustus Jones who assigned to Ruth 100 acres in Lot 1 Concession 1 of Township No. Fort Erie. At the bottom was written, “This Lott of one hundred achors is to be equally divided between Richard Ruth and Daniel Alward Jr. by the Board. Signed W. B. Sheehan, Clerk. On the reverse is a statement, “I Richard Ruth do sign my right of this sirtificate to John Peer forever. Richard Ruth made his mark, witnessed by Edward Peer. (Bertie Township Papers 0110)

On 3 May 1791 the Land Board read the petition of Daniel Alwood (sic) Senr. for a grant of 200 acres of land in the Township No 2 (Bertie) and found him qualified to receive a lot. The order was referred to Acting Surveyor General Augustus Jones who assigned to Alwood 100 acres in Lot 21 Concession 1 of Township No. with Broken Front (Bertie Township Papers 0237)

Acting Surveyor General D. W. Smith prepared an undated surveyor’s assignment for Daniel Alwood (sic) Senr. for 146 acres of land in Lot 21 Concession 1 Bertie Twp. and broken front (Bertie Township Papers 0235)

On 2 May 1797 Acting Surveyor General D. W. Smith prepared a surveyor’s assignment for Richard Ruth and Daniel Alwood Jr. stating were to equally divide between them, “Lot No. 5 first Concession towards Lake Erie, Bertie (being the Lot No. 1 of the south westerly addition to said Township).” He then described the boundaries of the 100 acres. Alwood, Henry

On 10 Jul 18[..] the Executive Council of Upper Canada gave a fiat to Henry Alwood of Grantham Twp. for 200 acres of land in Lots 26 and 27 Concession 2 Bertie Twp. (Bertie Township Papers 0349)

Anderson, John

On 15 Aug 1833 John Anderson wrote to Hon. Peter Robinson, Agent for the Crown and Clergy Reserves asking if the clergy reserve lots six and seven in the fifth and sixth concession of Bertie Twp. containing 400 acres are for sale- and, if so, what value is put upon them and the conditions. Anger, Augustus

On 3 May 1791 the Land Board read the petition of Augustus Anger for a grant of 200 acres of land in the Township No. Fort Erie (Bertie) and found him qualified to receive a lot. The order was referred to Acting Surveyor General Augustus Jones who assigned to him 200 acres in Lot 9 Concession 6 and Lot 10 Concession 6 from the Niagara River of Township No. Fort Erie (Bertie Township Papers 0514)

On 3 May 1791 the Land Board read the petition of Augustus Anger for a grant of 300 acres of land in the Township No. Fort Erie (Bertie). The Board found he has received land as private in Col. Butlers Rangers that he has settled on and has improved it. The Board found him qualified to receive a further assignment of 200 acres for his family. The order was referred to Acting Surveyor General Augustus Jones who assigned to him 200 acres in Lot 8 Concession 6 and Lot 8 Concession 7 from the Niagara River of Township No. Fort Erie (Bertie Township Papers 0577)

On 20 Oct 1795 Acting Surveyor General D. W. Smith prepared a surveyor’s assignment for Augustus Anger for 400 acres of land in Lot 9 Concession 5, Lots 8 and 10 Concession 6 and Lot 8 Concession 7 from the Niagara River Bertie Twp. (Bertie Township Papers 0611)

On 3 Jun 1796 John Johnson certified and acknowledged it was by mere accident that his name came onto Lot 7 Concession 7 Bertie Twp. and that August Anger had a large improvement on the same lot before his name was set on the map. After finding it out he went to Mr. Warren and declared before him he had no claim. If his name was still on the map he gave permission to the Surveyor General to erase it and to give it to August Anger. John “Jonson” made his mark. Witnessed by Ralph Johnson and John Gill. On 20 Oct 1795 Acting Surveyor General D. W. Smith prepared a surveyor’s assignment for Charles Anger for 200 acres of land in Lot 1 Concessions 10 and 11 from the Niagara River Bertie Twp. (Bertie Township Papers 0611)

On 8 Jun 1796 Charles Anger certified that he quit all claim to Lot 21 Concession 3 Bertie Twp. and returned it as being vacant land to be possessed by Michael Huffman he laying his right thereon. Signed by Charles Anger and witnessed by John Garner (Bertie Township Papers 0424)

Anguish, Henry

On 30 Sep 1796 Acting Surveyor General D. W. Smith prepared a surveyor’s assignment for Henry Anguish of Bertie Twp., yeoman, UE, late of Butler’s Rangers for 200 acres of land in Lot 7 Concession 10 and Lot 8 Concession 9 from the Niagara River Bertie Twp. as per Order in Council dated 12 May 1796 (Bertie Township Papers 0687)

On 16 Sep 1797 John Powell wrote to D. W. Smith Esq. that it was agreed at the Land Board that Lots 8 and 9 in Concession 1 Fort Erie Township (sic: Bertie) should be divided in three equal parts between Philip Wintermute, Henry Angerish and himself—settled before the Land Board the 4th of November 1791 (Bertie Township Papers 0171)

On 13 Apr 1806 William Jarvis wrote that there has not been a deed completed in the name of Henry Anguish for Lot 8 Concession 1 in Bertie. (Bertie Township Papers 0167)

Extract from the Attorney General issued by the Surveyor General’s Office on 11 Apr 1806 noting Land Board Certificate 3 May 1791 and Mr. Jones Deputy Surveyor`s assignment for Lots 8 and 9 Concession 1 Bertie Twp. with the partition by order of the Land Board as follows, vizt. “These two Lots are to be equally divided between Philip Wintermute, John Powell Eq and Henry Anguish who are to have one third each.” (Bertie Township Papers 0175)

On 16 Jun 1806 Acting Surveyor General Thomas Ridout gave a surveyor’s description to Henry Anguish of Bertie Twp. for 60 acres of land in the south part of Lot 8 Front Concession from the Niagara River Bertie Twp. as per a Land Board Certificate of 3 May 1791 and Mr. Jones’ assignment to Philip Wintermute and the partition order of the Land Board (Bertie Township Papers 0470)

Anguish, Jacob

On 27 Jan 1796 John Warren wrote that Jacob Anguish has been possessed of Lot 14 in the third concession of the Township of Bertie for some years and did last summer agree with Frederick Garrison to have Lot 14 in the second concession in front of his said lot and has paid Garrison most part of the money agreed upon for said Lot. Garrison has sold said lot to Silas Carter who at the time he bought it did not know it had been sold before to Anguish. Jacob Anguish says that Frederick Garrison is likewise known by the name Frederick Seager (Bertie Township Papers 0411)

On 11 Mar 1806 Surveyor General C. B. Wyatt gave a grant and survey to Jacob Anguish of Bertie Twp., yeoman, son of the late Jacob Anguish the Elder for 100 acres of land in Lot 14 Concession 2 from Lake Erie Bertie Twp. as per an Order in Council of 8 Oct 1796 and Warrant of 6 Jan 1796 (Bertie Township Papers 0319)

Askin, Abraham

Acting Surveyor General D. W. Smith prepared an undated surveyor’s assignment for Abraham Askin of Bertie Twp. for 100 acres of land in Lot 1 Concession 5 from the Niagara River Bertie Twp. as per a warrant of 8 Jun 1796 for 200 acres upon a Magistrate`s recommendation. On 3 Jan 1797 Abraham Smith wrote to Surveyor General D. W. Smith Esq. saying he received his letter of 10 Dec concerning his land. All that he claimed is No. 1 in the 5 Concession in Bertie, No. 1 in the 2 Concession in Humberstone. That is all the land he has taken up. One he sold to John Chambers and the other to Joseph Richard Palmer. Signed Abraham Askin. (Bertie Township Papers 0495)

On 17 Jan 1797 Alexander Askin wrote saying he had a letter of 11th inst. this morning. The land he claimed was Lot 1 Concession 5 from the River in Bertie and the front half of Lot 1 Concession 2 Humberstone Twp. in all 200 acres and requested the deed. Baxter, David

On 23 Aug 1794 the Land Board read the petition of David Baxter for a grant of 200 acres of land and found him qualified to receive a lot. The order was referred to Acting Surveyor General Augustus Jones who assigned to Baxter 160 acres in Lot 27 Front Concession and 100 acres in Lot 27 Concession 1 of Township of Fort Erie (Bertie Township Papers 0254)

On 14 Jun 1801 David Baxter wrote: “Worthy Sirs—permit me to acquaint your honor of an affair that is in dispute between myself and two sons, viz. I came into Canada in the year 1785 in hard times, proved my loyalty to Major Campbell and obtained a grant of him for 3 Hundred Acres of land and agreeable thereto I Settled on the 3d kot in front above fort Erie, built a house, raised a barn and cleared Some of the land. Now hard times Seemed to Come on and I having property in the State of North Carolina in the 1788 I went there for my property, thinking [this] Should be Safe untill I Should return but things turned out so that I Stayed on till 1792 and returned to my family, and to my great surprise and loss, my boys tells me that the ticket Major Campbell gave me is put aside and the land that I Settled is taken from me and given to Thomas and John beside their own quota of land lying in long point. Now Sir these things is much against me that my gifted lands Should be taken from me in such a manner. Now all things Considered I request of your honour to delay giving them Deeds for my land until a further Settlement be granted it. They tells me I may Stay my lifetime on the land but I am unwilling to let them have the authority over me in that respect as the land was granted, Surveyed and entered in my Name and for me in the records of the Surveyor Books of the Township of Bertie &c, Fort Erie And Now please your Honour Consider this affair and let Justice be done as I am Craving nothing but my right. And Now honourable Sir I Beg your attention to the within and if any redress can be obtained in my favour I humbly beg of you to let me know in a line or two directed to the Care Sgr Warren—and for Your prosperity and good health Your Subscriber. Baxter, John

On 11 Aug 1799 Thomas and John Baxter sent a letter to Acting Surveyor General D. W. Smith requesting he send by the bearer James Brown the number of the lot that makes up the 100 acres with the broken front No. 3 in Township of Bertie. (Bertie Township Papers 0125)

On 1 Aug 1801 John Warren wrote to Deputy Surveyor General D. W. Smith … “Thomas Baxter has shown me Mr. Ridout’s letter of last year saying that to secure his Land, he ought to lodge the Warrant in the Office. This Baxter says he immediately did on receiving it from the Council (tho I perceived in his Letter to you, he says the Lan Board) that it was for Seven hundred acres to himself and his Brother John. The division made between them, by mutual consent, 400 to Thomas and 300 acres to John. Thomas has obtained a Deed for 200 in Bertie, being the Lots number Three with the broken land in front in the first Concession on the Lake, and number Six in the Third concession on the River. The other 200 acres for which he wishes to obtain a Deed, is in the Lot number Sixteen fourth Concession Charlotte Villa [Charlotteville Twp., Norfolk Co.] As John has got married and has removed, Thomas does not know whether he has obtained a Deed for his Lands but says these Lots that he owns are number Three in the Second Concession on the Lake in Bertie and number Thirteen in the fifth Concession of Charlotte Villa.

“They are both good young Men. It was in consequence of his recommendation that they obtained the Extra 300 acres at the time His Excellency Lieut. Governor Simcoe signified his intention of encouraging industry by granting extra land to such as could obtain recommendations from the Magistrates of their having made good improvements. I recommended only Three to all of whom his Excellency was pleased to grant more or less.

“The misunderstanding between Baxter and his Father rests entirely with the Old Man. He came here at an early period of this Settlement and set himself down on this above mentioned lot number Three and being from Ireland he has been more accustomed to the Spade than to the Ax and did very little. Th[e] times [….] hard and he ran off to the back part of South Carolina. He left his wife and four Boys in much distress, Thomas and John being the Eldest, as they grew up to Manhood wrought hard; and maintained their family. Thomas at last discovered where the Old Man was, and John made [the] Journey of Eight hundred Miles [….] to the place. […..] he might persuade his Father to come back to an[…..] he had Justly forfeited during the interval of his absence. Thomas got the two lots number three entered in his own and his Brother John’s name and [….] this old […..] as to think the have disinherited him. [….] old Woman, during his absence obtained a Warrant for 400 acres in Blenheim, being the Lots number one and three in the Thirteenth Concession. The old Man is […..] in teaching Children to Read…. On 4 Feb 1804 Peter Russell wrote John Baxter has paid into this office £6.10.4 for the following deeds: north half of No. 13 in 5th Concession of Charlotteville and Lot No. 3 in 2d Concession and for 60 acres of the west side No. 4 in 9th Concession of Bertie making 260 acres (Bertie Township Papers 0198)

On 4 Feb 1807 Acting Surveyors General Chewet and Ridout wrote that Lot 12 in the broken front, Concessions 1 and 2 containing 220 acres under a Land Board Certificate have been described to Patrick Chambers. John Baxter has been entered for the north half of Lot 13 in the 5th Concession of Charlotteville. He is also entered in Bertie for Lot 13 in the 2nd Bertie and for 60 acres of the west side of Lot 4 in the 9th Concession of Bertie making in all 260 acres. A warrant of the 12th October 1796 has been lodged for 200 to the said John Baxter but stayed for payment of survey. (Bertie Township Papers 0199)

On 3 Feb 1825 John Baxter wrote a letter to Surveyor Thomas Ridout regarding his deed for Lot 27 Bertie Twp. east of Point Abino. He thought according to the deed it contained 200 acres but there is but 124 acres. He gave four hundred pounds currency for the land thinking according to the patent it not so far deficient. He went on the lot next in the rear. Some years after located the Broken Front and what he wanted to know was whether that was to make up the deficiency of the Broken Front. Added note stated the land in question in Bertie was surveyed by Mr. Grant in front and by Hambly in rear. (Bertie Township Papers 0041)

On 7 Feb 1804 the Executive Council of Upper Canada gave a grant to John Baxter of Bertie Twp., farmer for about 60 acres of land in the west part of Lot 4 Concession 9 from the Niagara River Bertie Twp. Peter Russell, Receiver General certified that John Baxter paid five pounds eleven shillings being the full officers fees on a grant of sixty acres and one pound for surveying fees. On 4 Aug 1818 John Baxter wrote to Surveyor General Thomas Ridout informing him of a dispute between himself and Silas Carter. Baxter lived on Lot 12 on the Lake and purchased from John Chambers in the year 1799. The stake between Lots 12 and 13 in front was gone. When he came here to live there was was a road claim and work by the public and a crossway marked and in making it was careful to stake out the line in order to keep the crossway on the east side of the line and the trees were cut away for the purpose of ditching. Mr. Carter employed Burwell to survey one hundred and fifty acres of the rear of his farm which he sold to Mr. Douglass. In the year 1814 Mr. Carter began to dispute the crossway and said it was on his land. Baxter then employed the late Capt. George Lawe to ascertain the line and found it corresponded with Col. Burwell’s stakes and the original marks in the rear…. (Bertie Township Papers 0205)

Baxter, Thomas

On 11 Aug 1799 Thomas and John Baxter sent a letter to Acting Surveyor General D. W. Smith requesting he send by the bearer James Brown the number of the lot that makes up the 100 acres with the broken front No. 3 in Township of Bertie. (Bertie Township Papers 0125)

On 7 Feb 1804 the Executive Council issue a grant Thomas Baxter of the Township of Bertie, yeoman for forty acres in the broken front of No. 3 in Bertie. On 7 Feb 1804 Receiver General Peter Russell acknowledge he received from Thomas Baxter eleven shillings for the fees on a grant of forty acres and one pound for surveying fees thereon. Bearss, David

On 25 Mar 1807 William Jarvis, Secretary wrote John Dettor paid three pounds five shillings and two pence on account of David Bearss for one hundred acres in Bertie. Lot 8 Concession 5 Bertie. (Bertie Township Papers 0511)

Bender, Philip

On 30 Jun 1795 Phillip Berninger Junr. aged 21, born in Pennsylvania, farmer appeared before W. Ball J. P. and took the prescribed oaths and was recommended for a grant of 200 acres of land. Brown, Catharine

In an undated letter Catharine Brown certified she acknowledged the lot on the north side of Lot 16 (Concession 15) granted to Benjamin Hardison in the Township of Bertie was improved and cultivated by him and her name inserted on the map of the survey is a mistake she never having any claim to the said lot. On 10 Dec 1794 Frederick Buck aged 23, born in the States, Labourer appeared before John Small and took the prescribed oaths and was recommended for a grant of 200 acres of land. On 10 Dec 1794 Michael Buck aged 20, born in the States, labourer appeared before John Small and took the prescribed oaths and was recommended for a grant of 200 acres of land. On 22 Oct 1796 Frederick Berger deposited at the Surveyor General’s Office an endorsement of Christian Riselay, a Land Board certificate, an endorsement respecting Coppen, a certificate of Mr. Frey, a survey by Allan McDonell and another paper perhaps by Mr. Warren (Bertie Township Papers 0309)

On 21 Oct 1796 Christian Riselay certified he was present when John Coppen surrendered his claim to Lot 10 Concession 2 Bertie Twp. and accepted Lot 13 Concession 6 in lieu thereof. This was done in the presence of Mr. Frey to accommodate Frederick Berger. (Bertie Township Papers 0310)

On 27 May 1802 the Surveyor’s Office wrote to the Attorney General that Frederick Burger claimed Lot 10 Concession 2 Bertie Twp. and had lodged this day his caveat in this office against the deed issuing to any other person until further orders. (Bertie Township Papers 0308)

Burns, James

On 29 Mar 1797 James Burns of Bertie Twp. appeared before David William Smith Esqr. J. P. and swore he resides on Lots 4 and 5 Concession 8 Bertie Twp. and has done so for these five years past. James Burns made his mark (Bertie Township Papers 0643)

On 9 Apr 1808, John Warren J. P. certified that James Burns resided in the Township of Bertie from the first formation of the settlement and occupied Lots 4 and 5 Concession 8 about fourteen years. A note below this stated the bearer wished to know if a description had issued for 200 acres of land granted him under Order in Council 12 Jul 1796. A further note below by the authority in the Surveyor General’s Office OC 12 Jul 1797 to James Burns, late in the Indian Department for 300 acres to be made up to him. A description issued to him for the front half of Lot 12 in the 4th Concession of Humberstone 100 acres. He is entered for Lots 4 and 5 in the 8th Concession of Bertie 200 acres. Total 300 acres.
