CITY OF ELGIN, OREGON RESOLUTION 22 (2025)
A RESOLUTION AUTHORIZING THE PLACEMENT OF LIEN ON REAL PROPERTY LOCATED ON TAX LOT ACCOUNT 13302 MAP #01N3915-DD-01900, 8th AVE, ELGIN, UNION COUNTY, OREGON
WHEREAS, the Elgin Municipal Judge ruled in favor of the City of Elgin in the matter of City of Elgin v. Skylar Payne on June 26, 2024; and
WHEREAS, the charges arise from the judgement for nuisances affecting public health; and
WHEREAS, the charges arise from the judgement for attractive nuisances; and
WHEREAS, the charges arise from the judgement for unenumerated nuisances; and
WHEREAS, the charges arise from the judgement for improper storage and exposure of multiple motor vehicles; and
WHEREAS, Mr. Payne is guilty on all counts and enters a conviction on all counts;
WHEREAS, the judgement rendered has been invoiced and that neither the $2,000 nor any part thereof has been paid at said address;
WHEREAS, the City Administrator ordered a summary abatement on July 9, 2025, and City employees and volunteers cleared the property of materials ordered by the Elgin Municipal Judge due to a failure to clear the property by July 26, 2024;
WHEREAS, $101.50 in transfer station fees were incurred by the City of Elgin,Â
RESOLVED, a Lien in the amount of $2,362.15 ($2,000 judgment and transfer station fees plus 10% Administrative Fee, plus $152.00 Lien Filing Fees) is hereby declared as attaching to the above identified real property since charges owing to the City of Elgin are now past due and the Union County Clerk is hereby instructed to record the lien in the appropriate record book.
