CITY OF ELGIN, OREGON RESOLUTION 1324 (2014)
AMENDING THE SUNSET DATE OF ORDINANCE TITLE 17 CHAPTER 17.40.140 ESTABLISHING THE AUTHORITY TO IMPOSE A MORATORIUM ON MARIJUANA DISPENSARIES WITHIN THE ELGIN CITY LIMITS
WHEREAS: The City of Elgin has determined that the establishment of Marijuana Facilities/Dispensaries within the city limits of Elgin would negatively affect the health, safety and welfare of the citizens and visitors to our community; and in addition be in violation of Federal Law.
WHEREAS: Therefore, the City of Elgin hereby places a moratorium on the establishment and location of Marijuana Facilities/Dispensaries, to include those described in House Bill 3460 that was approved by the Oregon Legislature in the 2013 Special Session, within Elgin.
WHEREAS: Any person, firm, organization or other entity that violates this ordinance shall be subject to a fine not to exceed $5,000.00 per violation.
WHEREAS: This ordinance will sunset and no longer be in effect on midnight April 30, 2014. This date has been amended from May 31, 2015.
NOW THEREFORE BE IT RESOLVED THAT: The City of Elgin adopts Ordinance Title17, Chapter 17.40.140 establishing the authority to impose a moratorium on marijuana dispensaries with the Elgin City limits. Ordinance Title 17, Chapter 17.40.140 attached.
