CITY OF ELGIN, OREGON RESOLUTION 19 (2017)
A RESOLUTION AMENDING RESOLUTION 1330 (2014) A RESOLUTION SETTING USER RATE FEES FOR THE CITY OF ELGIN SEWER SYSTEM.
WHEREAS: Ordinance 3 series 1981 and Ordinance 2 series 1992 require sewer rates to be set by resolution, AND;
WHEREAS: The adopted budget for fiscal year 2017/2018 requires user fees to meet the required resources.
BE IT RESOLVED THAT: The sewer fees, per the requirements of Ordinance 3-1981 and Ordinance 2-1992, beginning July 1, 2017 shall be as follows:
BASIC RATE
1 account with 1 unit is $38.75/ month.
Multiple units shall be charged the basic rate for each unit
SPECIAL RATES:
The commercial "overage" shall be calculated at $0.0020/Cu. ft. of water use metered over and above 1,800 Cu.ft./month.
Firemen, City Councilors, and qualifying senior citizens shall have their basic charge reduced by $3.50, for a rate of $$30.25/ month.
Accounts which become delinquent (i.e. remain unpaid on the first day of the month following the month in which the billing is presented) are to be charged a fee of $10.00.
The sewer usage for the schools and Boise Cascade mill shall be calculated based on the number of persons occupying these facilities, as follows:
3.3 Cu. Ft. per person per day for Stella-Mayfield and Elgin High School; each school shall be counted as two (2) units.
2.0 Cu. Ft. per person per shift for BCC Stud mill plywood mill complex; the mill is to be counted as four (4) units.
Multiple commercial housing units shall be charged one (1) basic rate for each housing unit.
BE IT FURTHER RESOLVED: That the City Council finds these fees to be necessary to pay the costs of supplies, materials and services purchased by the City, the need to maintain a reserve fund adequate to offset system depreciation, and the necessity of maintaining adequate resources to pay debt and debt service fees, AND;
BE IT FINALLY RESOLVED: That the City Council finds these fees and charges to be those necessary to operate the sewer system and are not "taxes" subject to limitation by the Constitution of the State of Oregon.
