CITY OF ELGIN, OREGON RESOLUTION 11 (2024)
A RESOLUTION SETTING USER RATES FOR THE CITY OF ELGIN WATER SYSTEM
WHEREAS, Ordinance 5 Series 1981 requires Water Rates to be set by resolution, and;
WHEREAS, The adopted budget for fiscal year 2024/2025 requires user fees to provide the required resources:
NOW THEREFORE BE IT RESOLVED, that the water user fees, per the requirements of Ordinance 5-1981, beginning July 1, 2024 shall be set as follows.
BASIC RATE
One account with one unit is $42.50 /month for up to 1,800 cu. ft. of use;
Multiple residential or commercial units shall be charged the basic rate for each unit
The "overage" shall be charged to all units for use over 1,800 cu. ft./month at the rate of 0.004 cents per cu. ft. for use from 1,800 cu. ft./mo. to 5,000 cu .ft./mo. and at 0.055 cents per cu. ft. for use over 5,000 cu. ft./month.
SPECIAL RATES:
a) Senior citizens, 65 and older, with a total income of less than $12,000 per year for a single person, or less than $16,000 per year for two or more persons, shall qualify for a reduced rate of $26.50 per month for minimum water usage of up to 1,800 cu. ft. per month.
b) City employees, retired city employees, current city councilors, firemen, retired firemen retired, council members serving greater than 20 years, EMTs and police reserve officers and retired EMT’s/police reserve officers whose residence is serviced by the City water system shall receive basic water for $18.50/ month up to 1,800 cu. ft. per month.
c) All accounts located outside the Elgin City limits shall be charged at 2.0 times the above rates for the minimum usage, (up to 1,800 cu. ft.).
d) Charges for special services shall be as follows:
1) Fee for posting final disconnects notice, "door-knocker", 17.50.
2) Fee for turning on or off a meter is $32.50 during work hours $65.00 after hours.
4) Fee for receiving bulk water from a hydrant for out of town use by authorized personnel only, $40.00 per 1,000 gal. Tank and the fee for such service is $35.50 during work hours $65.00 after hours.
e) Accounts which become delinquent (i.e. remain unpaid on the first day of the month following the month in which the billing is presented) are to be charged a fee of $10.00.
f) Checks returned for Non-sufficient funds will be charged $20.00 handing fee.
BE IT FURTHER RESOLVED, that the City Council finds these fees are necessary to insure the capacity to meet operation and debt costs, and the necessity of maintaining adequate resources to accumulate funds against system depreciation.
BE IT FINALLY RESOLVED, that the City Council finds these fees and charges to be those necessary to operate the water system and are not “taxes” subject to limitation by the Constitution of the State of Oregon
